Legislative Update: Congress Advances New Legislation While Apprenticeship Regulations Are Unveiled

This week both the House and Senate considered and advanced several pieces of legislation with implications for the Career Technical Education (CTE) community. Elsewhere the U.S. Department of Labor (DOL) published proposed regulations that would overhaul the existing framework for registered apprenticeship programs and significantly expand the scope of these rules in relation to CTE programs funded by the Carl D. Perkins Career and Technical Education Act (Perkins V).  

House Education and Workforce Committee Advances WIOA Reauthorization

This week the House Education and Workforce (E&W) Committee marked up and advanced H.R. 6655, A Stronger Workforce for America Act (ASWA). The legislation would reauthorize the Workforce Innovation and Opportunity Act (WIOA), which was last updated in 2014. Notably for the CTE community, the legislation proposes significant changes to youth funding authorized by the legislation, including changes to the underlying definition for eligible youth populations that would allow for greater coordination and alignment with CTE programs. ASWA would also encourage greater local alignment of CTE programs of study and career pathways programs. The legislation would also codify the Workforce Data Quality Initiative and the Strengthening Community College Workforce Development Grant program– two key Advance CTE WIOA priorities– along with a host of other proposed changes to current law. However, Advance CTE is still analyzing additional elements of the legislation that were less encouraging and plans to issue a more comprehensive response regarding the legislation shortly. 

The bipartisan legislation was advanced out of the E&W Committee on Tuesday by a margin of 44-1. The proposal is expected to be further considered by the full House of Representatives sometime next year when Congress returns from its holiday recess. 

House Leaders Markup New Workforce Pell Proposal 

As shared previously, Reps. Stefanik (R-NY) and DeSaulnier (D-CA), along with House Education and Workforce Committee Chair Foxx (R-NC) and Ranking Member Scott (D-VA), recently introduced H.R. 6586, the Bipartisan Workforce Pell Act (BWPA) last week. The bipartisan legislation is a compromise between previously introduced legislation sponsored by the E&W Committee Chair and Ranking Member earlier this Congress. The expansion of Pell eligibility for high-quality, shorter-term CTE programs has been a longtime priority of Advance CTE

Notably, the legislation was amended during markup in several ways, including a new provision requiring coordination with state Perkins eligible agencies in determining programmatic alignment to high-skill, high-wage or in-demand occupations and sectors. The BWPA also contains a slew of new eligibility criteria that would be overseen and implemented by the U.S. Department of Education (ED), state workforce development boards and higher education accreditation agencies. Advance CTE and the Association for Career Technical Education issued a letter in response to the BWPA shortly after its passage out of the E&W Committee on a margin of 37-8. Advance CTE is encouraged by this latest development and looks forward to working with Congress as this issue moves forward in the legislative process. 

HELP Committee Clears Bipartisan Education Sciences Reform Act Reauthorization

Last week, the Senate Health, Education, Labor and Pensions (HELP) Committee formally introduced the Advancing Research in Education Act (AREA) — bipartisan legislation that would reauthorize and update the Education Sciences Reform Act (ESRA). This legislation makes important updates to ESRA, including significant reforms to the State Longitudinal Data System Grant program and broader education research and technical assistance functions overseen by the ED. As shared previously, Advance CTE has strongly supported many of the core components of AREA, particularly provisions that complement and relate to CTE, and has formally supported the legislation ahead of a scheduled markup this past Tuesday. The HELP Committee subsequently advanced this proposal on an overwhelmingly bipartisan basis, 20-1. AREA now moves to the full Senate for further consideration by the upper chamber. 

DOL Proposes Major Changes to Apprenticeship Regulations With CTE Implications 

Yesterday, the U.S. Department of Labor (DOL) published a notice of proposed rulemaking (NPRM) that proposes significant and wide-ranging changes to the regulatory framework for registered apprenticeship programs. Of note for the CTE community, the NPRM suggests a significant expansion of the regulatory requirements related to a new program model DOL is currently referencing as “CTE Apprenticeships.” The NPRM includes a number of other new regulatory requirements that would relate to CTE programs funded by Perkins V. Advance CTE is in the process of analyzing this proposal and will have more to share on this NPRM soon. A 60-day comment period will begin when the draft proposal is formally published to the Federal Register. In addition, DOL has scheduled a webinar in early January to provide an overview of the NPRM.

CTE Research Review: Q&A with Shaun Dougherty on the Impacts of CTE Access on Learner Outcomes in Connecticut

This research review series features interviews with three CTE researchers— Julie Edmunds, Shaun Dougherty, and Rachel Rosen — to highlight new and relevant Career Technical Education (CTE) research topics being pursued and discuss how state CTE leaders might leverage these to make evidence-based decisions. This series is conducted in partnership with the Career and Technical Education Research Network, which is providing new CTE impact studies and strengthening the capacity of the field to conduct and use rigorous CTE research.

For the final post in this series, Advance CTE caught up with researcher Shaun Dougherty to learn more about the outcomes of his study, The Effects of Career and Technical Education: Evidence from the Connecticut Technical High School SystemThis study took place at The Connecticut Technical High School System (CTHSS), an independent district of choice composed of 16 high schools where all students who attend the school participate in some form of CTE. The technical high schools in this study offer between 10 and 17 programs of study compared to the two to four typically offered at traditional comprehensive high schools. These findings suggest that student participation in CTE programs can improve graduation and college enrollment rates, and labor force participation, especially for male students. These findings should be meaningful to state leaders who are interested in improving CTE data quality to improve programming and learner supports.

How do your research findings advance the CTE field’s understanding of ways to better serve learners?

My findings in Connecticut and an earlier study in Massachusetts suggest that increasing access to high-quality CTE-focused schools can improve high school graduation rates, test scores, and early workforce experiences (earnings especially). These findings suggest that ensuring access to high-quality CTE is important, especially in areas where there is high demand for it among students. In Connecticut, we show that the benefits accrue to males only, but in Massachusetts, the impacts are broader-based and larger for students who come from less financially advantaged backgrounds. 

What is also important about both of these contexts is that students are attending CTE-dedicated high schools, which is the least common form of CTE instructional delivery in the United States. Students explore multiple programs in 9th grade and then make an informed decision about what program of study to pursue for the rest of their high school experience. Within the program they choose, they then have a relatively stable set of peers and instructors, and there is alignment between content in the state graduation requirements, such as math and English Language Arts (ELA), and their technical area of study. Each of these dimensions of the experience tends not to exist in CTE delivered in comprehensive high schools or regional technical centers.

What findings would you highlight for state CTE leaders in particular?

In particular, I’d highlight the following:

You find male students enrolled in Connecticut’s Technical High School System (CTHSS) are more likely to graduate high school and experience a notable wage increase compared to males attending traditional high schools, yet this effect is not seen among female students. What do you make of this finding? 

There are two things worth noting here:

Can you tell me about how you were able to leverage the state’s longitudinal data system, the value that this process brought to your work, and about any limitations you encountered??

We matched the CTHSS admissions records to the Connecticut State Department of Education’s (CSDE) longitudinal data system sequentially using the following criteria: SASID, exact match on first and last name plus birth year, first initial and exact match on last name plus birth year and month, and exact match on last name plus exact birth date. The reason for the sequential match process is reporting errors in the CTHSS application file on birth dates, spelling errors and uses of nicknames in the application file that parents and/or students fill out by hand. A failure to match after applying all of these criteria leads to the observation being omitted from the sample. Our resulting match rate was 95 percent yielding a final sample of 57,658 student applications.

From the CSDE longitudinal data system, we obtained information on each student’s race, gender, free or reduced-price lunch status, English learner and special education status (i.e. presence of an IEP).

The CSDE data also provided information on short- and medium-term educational outcomes including standardized test scores prior to and during high school, attendance, and high school graduation, as well as information on college attendance drawn from the National Student Clearinghouse.

Further, through the P20Win process, students in our sample were matched to Connecticut State Department of Labor (CSDOL) data. This CSDOL match is facilitated by Department of Motor Vehicle records that contain gender, birth date, and first and last name and is matched to the CSDOL data using social security numbers. CSDOL personnel then matched the resulting data to the CSDE data using an exact match on birth date and gender and a fuzzy match algorithm on the student’s name.

Failure to match applicants in the CSDOL data may have been driven by several factors including never having a driver’s license in the state of Connecticut, name changes due to marriage or other factors, moving out of state prior to or upon the completion of high school or failure to participate in the labor market after high school perhaps due to college attendance. Our labor market data ends in the 1st quarter of 2018. Therefore, we restrict this sample to the years 2006 to 2012 so that we have a potential for at least six quarters of data on each applicant.

Without the matching to the workforce outcomes, we would be left to wonder or speculate about what happened to most students, since there is no real evidence of impact on college-going (nor should we expect it early on for students who attended schools that emphasize manufacturing and skilled trades). Thus, the linkages were critical to being able to provide policymakers with relevant, detailed answers  

The primary limitation is that we cannot see workers who moved out of state, who were employed by the federal government, who work for unreported wages, or who are independent contractors. However, our takeaway is that our findings are likely an underestimate of the benefits of CTE. 

What new questions has this work raised for you that could be applied to future research?

The two biggest questions this work has raised for me so far are:

Unpacking Putting Learner Success First: Commitment Across Systems

A little over one year ago, Advance CTE launched Putting Learner Success First: A Shared Vision for the Future of CTE. This document, which was developed using input from a broad array of stakeholders, calls for a systematic transformation of the education system grounded in five principles. This blog series will dive into each principle, detailing the goals and progress made in each area.

All systems work together to put learner success first.

In order to deliver high-quality CTE for all learners, state systems must work together at every level. Secondary and postsecondary must work together and with agencies that handle workforce and economic development issues. All of those agencies must also engage with employer partners and local districts and institutions to inform the design, validation and implementation of CTE programs.

This engagement should include a common vision and goals, along with shared terminology and data, so that each system can function together efficiently.

Those who have signed onto the principle have committed to accomplishing this objective through the following actions:

Since the launch of Putting Learner Success First, Advance CTE has been conducting research and policy scans to raise up examples and promising practices related to this principle. Now, when state leaders place their focus on cross-sector coordination, they have access to multiple resources related to secondary and postsecondary partnerships, governance, accountability systems and statewide longitudinal data systems.

Strengthening the Teacher Workforce through Talent Management Pipeline Strategies

teacher talent pipelinesTalk to any rural district about challenges facing their school system and they’re likely to cite a teacher shortage. Recruiting and retaining high quality educators who are equipped to meet the demands of a 21st century classroom is one of the most pressing challenges the American education system faces today, affecting communities of all sizes and geographies. Crucially, Career Technical Education (CTE) classrooms – which demand highly-skilled teachers – are struggling to fill open positions.

A new report from the U.S. Chamber of Commerce Foundation (USCCF), released this week, examines teacher recruitment practices from school districts in Arizona and finds that many schools struggle to find teachers that are adequately prepared to support the diversity of student needs. Part of this preparation gap is due to the lack of formal systems to communicate teacher supply needs and build pathways into the classroom. Recognizing parallels with other industry workforce shortages, USCCF developed a set of recommendations for school districts to expand the pool of quality teachers through a talent pipeline management strategy. Recommendations include:

These strategies aim to improve the quality and supply of the teaching workforce by streamlining the talent pipeline and increasing avenues of communication and collaboration from the preparation to the recruitment stage. In regions where teacher workforce gaps exist, states should consider strategies to reach potential teachers earlier in the pipeline and expand pathways into the profession.

Promising News for College Promise

In his 2015 State of the Union address, President Obama called on Congress and the states to provide tuition free community college for students in the U.S. This proposal was inspired in part by the Tennessee Promise program, which provides last-dollar scholarships to eligible students in the state. In the time since then, free community college programs have expanded significantly, encompassing a total of 150 programs across 37 states. Researchers at the University of Pennsylvania recently developed a web-based platform that maps and details each of these programs. Additionally, the College Promise Campaign — a national, non-partisan initiative to research and advocate for Promise programs — released its 2016 annual report, profiling pioneer and emerging programs across the states. One example is the Oakland Promise program, which aims to reach back to early learning years in order to create a college-going culture and provide college and career advising supports throughout the K-12 education system. Students who qualify for the scholarship program can receive up to $16,000 towards their postsecondary education.

On a related note, the College Board released its annual “Trends in College Pricing Report” and found that in 2016-17, the average net tuition and fees paid by two-year college students was $920 less than before the Great Recession (though costs have increased since 2011-12). Over roughly the same period, state and local appropriations for higher education declined 9 percent.

Odds and Ends

talent shortage surveyShort on Talent. Manpower Group’s 2016/17 Talent Shortage Survey reports the highest global talent shortage since 2007, largely in the skilled trades, IT and sales industries. As a result, more than 50 percent of surveyed employers are training and developing existing staff in order to fill open positions.

Data Linkages. All 50 states plus D.C. have the ability to connect data between systems — but only 17 (plus D.C.) have a full P20W system. That’s according to the Education Commission of the States’ 50-state comparison of statewide longitudinal data systems.

For the Equity Toolbox. The National Skills Coalition released a set of five policy toolkits with resources and recommendations for adopting and aligning policies to expand equitable access to training, credentials and careers. Toolkits include stackable credentials and integrating education and training, among others.

Standards for CBE. C-BEN, a coalition of more than 30 colleges offering competency-based education (CBE) programs, released draft quality standards for CBE. The standards will be finalized early next year and focus on eight areas, including clear, measurable, meaningful and complete competencies and credential-level assessment strategy with robust implementation.
