Legislative Update: Veterans’ Training Bill, Appropriations, America COMPETES

Veterans’ Training Bill Passed; Expands Eligibility to Area CTE Centers

Late last week the House passed the Post-9/11 Veterans Educational Assistance Improvements Act of 2010 by a vote of 409-3, after it was cleared by unanimous consent in the Senate earlier in the week. The bill now goes to President Obama for his signature. This bill will allow veterans to use their benefits at educational institutions that do not award associate or higher degrees, such as area career technical schools, career schools, and apprenticeship programs. This would be a change from the current Post-9/11 GI Bill, which does not allow participants to use funds at a non-degree granting institution. The new eligibility provisions will go into effect on October 1, 2011. This is a tremendous victory for CTE and a recognition of the high quality programs that our area CTE centers offer!

Congress Passes Short-Term Continuing Resolution

The House on Tuesday passed a continuing resolution (CR) by a vote of 193 to 165 that would fund the government and all federal programs at FY10 levels through March 4. The Senate approved the bill earlier on Tuesday by a vote of 79-16. With the shift in power in the House, and the weakened Democratic hold over the Senate, there is sure to be a more partisan fight over spending as expiration of the CR draws near in March. Soon-to-be Speaker of the House John Boehner (Ohio) has already said that he wants to roll back federal spending to 2008 levels.

America COMPETES Act Passed by Congress

The House this week passed the America COMPETES Act by a vote of 228 to 130, after it was approved by unanimous consent in the Senate last week. The bill now heads to President Obama for his signature. The goal of the bill is to improve the competitiveness of the United States by investing in innovation through research and development. There are a variety of provisions in the bill that will impact STEM education, such as the coordination of federal STEM education efforts, grants to increase the number of STEM teachers, and other improvements in STEM education. Because Congress wanted to pass this bill before the current session of Congress ends, the House had little choice but to accept the Senate version of the bill which scales back funding from the original House bill and reauthorizes the bill for three years instead of five.

CR Clarifies Definition of Highly Qualified Teacher

The continuing resolution (CR) introduced by the Senate (summary here), which would fund the government through March 4, 2011, includes a definition of “highly qualified teacher” that would make it easier for alternatively certified teachers to become “highly qualified under the No Child Left Behind law. While this language has been in regulation since 2002, the U.S. Court of Appeals for the 9th Circuit struck down the regulation in September, saying that it went too far. The U.S. Department of Education regulation allows uncertified candidates in alternative-route programs to teach for up to three years while they seek certification. If passed, the CR would supersede the Circuit Court’s decision.

Senate May Vote on CR This Weekend

As we told you last week, the House passed a continuing resolution (CR) to fund the government until September 30, 2011, and we are awaiting action by the Senate. This week the Senate introduced an omnibus appropriations bill as a substitute, but last night Senate Majority Leader Harry Reid announced that the Senate would not vote on it because they did not have enough Republican support to pass it.  Instead the Senate plans to propose a CR that would be shorter than the one passed in the House.

NASDCTEc Fall Meeting: OVAE Holds Perkins Listening Session

The concluding session at last week’s Fall Meeting in Baltimore, Maryland was a listening session on Perkins reauthorization, moderated by Assistant Secretary for Vocational and Adult Education, Brenda Dann-Messier, and Sharon Miller, the director of the Division of Academic and Technical Education. Assistant Secretary Dann-Messier told the attendees that this listening session was going to be the start of a national conversation about Perkins reauthorization. She and her staff plan to host a series of listening sessions that will conclude at NASDCTEc’s Spring meeting in April 2011. She also said OVAE is soliciting feedback and comments from the public about Perkins reauthorization at [email protected].

The session was structured around four topic areas: Programs of Study, secondary to postsecondary transitions, performance measures, and whether there should be more specific or common measures and definitions, including regulations.

Programs of Study

o   Need to better engage postsecondary, but Perkins does not mandate secondary and postsecondary collaboration

o   Need a clear definition of POS

o   Not all community colleges offer all POS, so it can be limiting for students

o   It is also limiting for students that many four-year colleges do not accept credit from two-year institutions

Secondary to Postsecondary Transitions

o   Two-year schools are struggling to get four-year schools to accept credit

o   Not all states have statewide articulation agreements

o   As more and mores students flood into community colleges, there is less of a priority in serving high school students through articulation agreements and dual enrollment

Performance Measures

o   Academic attainment at secondary level – because students are often tested before 11th grade (when most students begin CTE), it is tough to the impact of CTE on academic attainment

o   Certificate completion at postsecondary level – the results go to the students, and it is hard for states to track this information

o   Technical skill attainment at secondary level – this is tough to measure, and is not always appropriate at the secondary level

o   Placement at the secondary level – tough to track because of FERPA restrictions on collecting data

Rep. Kline Outlines Education and Labor Priorities

With election day behind us and a shift in power in the House that leaves the future of a variety of policy issues uncertain, Rep. John Kline, the current ranking member of the House Education and Labor Committee (and potential chair during the next session), wasted no time in outlining his priorities for the committee. In a press release issued today, Kline set forth broad policy areas that the committee will focus on to “promote American competitiveness and hold government accountable.” Chief among his concerns is job creation and turning around the economy. Other priority issues that the committee will address in the 112th Congress include:

It remains to be seen what impact the change in House leadership and a divided Congress will have on pending legislation such the Elementary and Secondary Education Act and the Workforce Investment Act. Will Congress come together to pass these vitally important pieces of legislation? Or will the gridlock in Washington continue?

Community College Grant Solicitation Expected This Month

Last year, the American Recovery and Reinvestment Act amended the Trade Act to authorize a new Trade Adjustment Assistance Community College and Career Training Grant Program, which was then funded at $2 billion over four years by the healthcare bill in March. These grants will be available to institutions of higher education to expand their capacity to provide education and career training to TAA for Workers program participants and other individuals to upgrade their knowledge and skills so that they can find family-sustaining employment. The grant solicitation is expected to be released later this month.

The Department of Labor has released a fact sheet on the grant program outlining key issues and questions for colleges interested in applying for funds. Additional information can be found in the most recent issue of the Association of Community College Trustees’ Trustee Quarterly magazine, which features Q&A with Department of Education Under Secretary Martha Kanter and Department of Labor Assistant Secretary Jane Oates.

Legislative Update: Linked Learning, Green Workforce Development, Republican Pledge to America

Linked Learning Pathways to College, Career, and Citizenship Success Act

On September 22, Rep. Judy Chu (CA) introduced H.R. 6174, the Linked Learning Pathways to College, Career, and Citizenship Success Act, along with co-sponsor Rep. Barbara Lee (CA). The bill is aimed at preparing students for college and careers through the Linked Learning, or multiple pathways, approach. More specifically, the bill would award grants to school districts in partnership with local stakeholders, including businesses, unions, parent organizations, and other community members. At the district level, grants would be used for planning and implementation of a system of pathway schools around career themes designated as high pay, high growth, and high skill industries. At the school level, students would be exposed to four components: a rigorous academic core aligned to the state’s postsecondary requirements; career technical education; work-based learning, and supplemental services.

Green Workforce Development Through Community Colleges Act

Rep. Paul Tonko (NY) introduced H.R. 6142, the Green Workforce Development Through Community Colleges Act, which gives authority to the Secretaries of Labor, Energy and Education to jointly develop a workforce training and education program to prepare workers for careers in alternative energy and energy efficiency industries. The bill would award grants to community colleges to reach this goal.

Republican “Pledge to America”

Yesterday, Congressional Republicans issued their election policy platform, “A Pledge to America.” Education issues are not mentioned, but the document does include a plan to create jobs and make America more competitive if Republicans take control of the Congress in November. Their plan would include ending all tax increases, giving tax deductions to small businesses and repealing mandates that harm small businesses. The pledge also outlined a plan to cut spending by reducing discretionary spending to FY 2008 levels, rescinding unused ARRA funds, imposing hard caps on discretionary spending and sunsetting outdated and duplicative programs.

Legislative Update: Improving Student Testing Act, Education Jobs Fund

Congress returned from their August recess this week and is planning to be in session until October 8.

Improving Student Testing Act

Senators Russ Feingold (WI) and Pat Leahy (VT) this week introduced S. 3771, Improving Student Testing Act, which would provide grants to States, SEAs, LEAs and schools to design and implement high-quality and innovative assessments, including adaptive assessments, performance assessments, standardized portfolio assessments, interim assessments, and other assessments that measure higher-order thinking skills and are aligned with common core standards or State challenging academic content standards and challenging student academic achievement standards. This bill is aimed to be a part of the larger Elementary and Secondary Education Act reauthorization which will likely not happen until next year.

Education Jobs Fund

The U.S. Department of Education has approved 46 states, the District of Columbia, Puerto Rico, Guam, American Samoa, the Virgin Islands and the Northern Marianas for Education Jobs funding. Texas’ application was denied because it did not contain assurance to spend the money on education over the next three years. Department officials have asked the state to reapply. South Carolina and Wyoming do not have their applications posted on the Department’s website.

Education Jobs Fund Passes House, Goes to President for Signature

After being called back to Washington by Speaker Nancy Pelosi (CA), today the House voted 247-161 to pass a bill containing the $10 billion Education Jobs Fund. As we told you last week, the Senate has already passed the bill in their chamber, so the bill now heads to the White House for President Obama’s signature.The President and his Administration has lobbied in recent weeks for funding to save teachers’ jobs. At a press conference this morning, the President said, “[T]oday we’re trying to pass a law that will save hundreds of thousands of additional jobs in the coming year… If we do nothing, these educators won’t be returning to the classroom this fall. And that won’t just deprive them of a paycheck, it will deprive the children and parents who are counting on them to provide a decent education.”

This money would aid states and school districts in avoiding teacher layoffs and hiring new staff. The Department of Education is estimating that the fund will save 161,000 educator jobs. Education Jobs Clears the Senate

The Senate voted yesterday to pass the Murray-Harkin amendment, which includes $10 billion for education jobs and $16.1 billion for federal Medicaid payments. The amendment passed 61-39, with Senators Collins and Snowe the only Republicans to join all Democrats in voting for it. The House is scheduled to convene at 10 a.m. on Tuesday for a vote on the bill..

Veteran Employment Assistance Act

The Senate Committee on Veterans’ Affairs approved S. 3234, Veteran Employment Assistance Act of 2010, which would improve employment, training, and placement services furnished to veterans, especially those serving in Operation Iraqi Freedom and Operation Enduring Freedom. The bill will now be reported to the full Senate for consideration.

Senate HELP Hearing on For-Profit Schools

On Wednesday the Senate Committee on Health, Education, Labor and Pensions held a hearing on “For-Profit Schools: The Student Recruitment Experience.” The Committee heard from Gregory Kutz of GAO who recently conducted an investigation into the recruitment process at proprietary schools and found that the abuses are systemic and that oversight is lax. Joshua Pruyn, a former admissions representative at Westwood College, also testified about enrollment quotas imposed on reps, awards given for enrolling students, and the psychological games they were encouraged to play with prospective students.

21st Century STEM for Girls and Underrepresented Minorities Act

Rep. Lynn Woolsey (CA) introduced H.R. 6078, the 21st Century STEM for Girls and Underrepresented Minorities Act. This bill would amend ESEA to provide grants to LEAs to encourage girls and underrepresented minorities to pursue studies and careers in STEM.
