Legislative Update: Consensus on FY24 Remains Elusive as Artificial Intelligence Comes into Focus

This week, Congress has continued to make modest progress on appropriations legislation for the federal government while lawmakers and President Biden have begun to consider how to manage the coming use of artificial intelligence (AI) technologies. 

Congress No Closer to Agreement on Fiscal Year 2024 (FY24) Education Spending

With new House Speaker Mike Johnson (R-LA) in place and another possible government shutdown only two weeks away, a new sense of urgency has swept Capitol Hill as lawmakers worked to pass several appropriations measures in both chambers this week. In the House, the Labor, Health and Human Services, Education, and Related Agencies (Labor-HHS-ED) appropriations bill — legislation that provides funding for the Carl D. Perkins Career and Technical Education Act (Perkins V) and other important Career Technical Education (CTE) related investments—has been moved directly to the House floor for consideration and a vote is scheduled sometime the week of November 13. As a reminder, if enacted, this proposal would reduce funding for Title I of the Every Students Succeeds Act (ESSA) by 80 percent and would substantially cut funding or entirely eliminate many other education and workforce development programs like the Workforce Innovation and Opportunity Act (WIOA). 

The Senate has not yet scheduled further consideration of its own version of this legislation which most recently advanced out of the Appropriations Committee and is awaiting consideration by the upper chamber. Unlike the House version of this legislation, which would freeze current funding for Perkins V’s basic state grant program, the Senate’s proposal would provide a much-needed $43 million increase in support for the primary federal investment in CTE. 

Under the new leadership of Speaker Johnson, the House has continued to pass other spending proposals that would drastically cut federal funding for a variety of programs, falling well below the topline spending targets outlined in the Fiscal Responsibility Act (FRA) — a bipartisan agreement that was passed by Congress earlier this year which avoided a catastrophic default on the nation’s debt obligations. At the same time, the Senate has continued to advance spending proposals that conform to the FRA agreement. With both chambers proposing wildly different visions for FY24 funding, it remains unclear how lawmakers will move forward by the middle of this month. Unless agreement can be reached by the beginning of 2024, an across-the-board sequester cut to all federal programs, mandated by the FRA, will come into effect. As these efforts continue to unfold, Advance CTE is continuing to work with partners on Capitol Hill to ensure the funding needs of the wider CTE education community are met as part of this process. 

Biden Administration Unveils Artificial Intelligence Executive Order

On Monday, October 30, President Biden issued a wide-ranging Executive Order regarding the “Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence” (AI). The measure has several components of note for the CTE community including how to support workers displaced by AI, strategies for attracting and retaining AI talent and directing federal agencies to explore how to strengthen or expand pathways programs leading into AI or adjacent occupational fields. The Executive Order also directs the U.S. Department of Education (ED) to develop resources, policies, and guidance on AI in education within one year and similarly directs the Departments of Labor, Commerce and others to produce similar recommendations on legislative and regulatory actions that can better support workers and learners navigate a world changed by the implementation of AI and related technologies. Senate Examines AI’s Impact on the Workforce

Earlier this week, the Senate Health, Education, Labor and Pensions’ Subcommittee on Employment and Workforce Safety held a hearing titled, “AI and the Future of Work: Moving Forward Together.” The hearing featured testimony from witnesses representing the private sector and explored the potential impacts that AI will likely have on work as well as potential strategies to mitigate negative effects. A key theme of the hearing centered on the growing importance of lifelong learning, including the need to reform ways that the federal government supports learners pursuing postsecondary education. To that end, Senator Kaine (D-VA) highlighted the importance of Congress passing the JOBS Act – legislation that would expand Pell Grant eligibility for high-quality, shorter-term CTE programs. 

ED Distributes New Funding for Educator Diversity and Compensation Efforts

Late last week, the U.S. ED announced that it was awarding $115 million in new funding via the Teacher and School Leader Incentive Program — an initiative authorized by ESSA. These funds will support nearly 30 projects that aim to address teacher shortages while also increasing instructional staff diversity. This investment “… will help states and school districts recruit and retain new talent, increase compensation, and address educator shortages that we know disproportionately impact students from our communities of color, students from low-income backgrounds, students with disabilities and English learners,” U.S. Secretary of Education Miguel Cardona said, in part, as part of the announcement

Legislative Update: President Biden Releases Congressional Budget Request

This week President Biden released a much anticipated annual Congressional budget request for federal fiscal year 2024 (FY24).  In addition, House Republicans have made changes to appropriations legislation rules that impact CTE funding. Advance CTE asks members to encourage their representatives in  Congress to support much needed reforms to federal Pell Grants. 

President Biden Unveils FY24 Budget Request 

Earlier today, President Biden released his long-anticipated federal fiscal year 2024 (FY24) budget request to Congress. The request proposes a $43 million increase for the Carl D. Perkins Career and Technical Education Act’s (Perkins V) basic state grant program– a proposed three percent increase over FY23 enacted levels. Advance CTE and the Association for Career and Technical Education (ACTE) have been advocating for a $400 million increase for this program to close an inflationary gap in funding that has widened considerably since FY04. Advance CTE will continue to pursue this goal with partners on Capitol Hill as the wider FY24 process unfolds later this year.  

In addition, the Biden Administration has also renewed its request, first made last year, for $200 million in new funding for the creation of a new competitive grant program known as “Career Connected High Schools.” This initiative seeks to prioritize dual and concurrent enrollment, work-based learning, industry-recognized credentials and career counseling. Notably, Perkins V’s basic state grant program includes these priorities as eligible uses of funds and many states and local recipients currently use these resources to support these, and many more, opportunities for learners. Advance CTE has previously raised equity concerns regarding the Career Connected High Schools grant program–which the Administration estimated last year would only reach 32 programs in total–due to the limited scope and reach of a competitive grant program. Advance CTE and ACTE released a statement outlining these concerns following the formal publication of the budget. 

Encouragingly, the budget request proposes significant new mandatory and discretionary funding to make two years of community college tuition free, so long as students and institutions meet certain criteria. The request also proposes a $25 million increase in funding for Student Success and Academic Enrichment Grants (Title IV-A of the Every Student Succeeds Act)– another key source of federal funding that can be used in support of CTE. Regarding the U.S. Department of Labor’s (DOL) portion of the request, the Administration is proposing $50 million in additional funding for registered apprenticeship programs, $200 million for the creation of a sector-partnership grant program and $11 million for the Workforce Data Quality Initiative– nearly double the FY23 enacted level. Elsewhere in this portion of the budget, the Administration has proposed additional investments to improve labor market information and to modernize outdated IT systems to better serve workers.  

Additional details regarding the budget are expected to be available next week. The release of the budget formally begins the wider FY24 budget and appropriations process in Congress—an effort that is expected to be challenging in a divided Congress. As this process gets underway, Advance CTE will continue to work with partners on Capitol Hill to ensure the funding needs of the CTE community are reflected in final legislation. 

House Republicans Ban Education Earmarks

For the last few years, members of Congress have been able to make specific funding requests in support of projects or initiatives related to their home state or district. Known formally as “community project funding” in the House and informally as “earmarks” elsewhere, these requests totaled $290 million in last year’s (FY23) spending package for career education initiatives. Last week, House Appropriations Chair Kay Granger (R-TX) announced new guidance for the upcoming FY24 budget and appropriations process. Among other notable changes, the guidance will not allow earmarks for the Labor-HHS-Education funding bill—legislation where Perkins V derives funding—in the upcoming budget and appropriations cycle. Elsewhere, the Senate has announced that it will still allow such requests this year which will be due April 13. 

Encourage Congress to Support the Short-term Pell Grant Expansion

As shared previously, Senators Tim Kaine (D-VA) and Mike Braun (R-IN) reintroduced the Jumpstarting our Businesses by Supporting Students (JOBS) Act (S.161)– legislation that would expand federal Pell grant funding eligibility to high-quality, shorter-term CTE programs that meet certain criteria. Most recently companion legislation has been introduced in the House (H.R. 793) by Representatives Bill Johnson (R-OH), Lisa Blunt-Rochester (D-DE), Michael Turner (R-OH) and Mikie Sherrill (D-NJ). 

This legislation is a longstanding federal policy priority for Advance CTE and is an important way to expand learner access to high-quality CTE program opportunities at the postsecondary level. Legislative Update: Teacher Pay and Healthcare Workforce Shortages a Focus as Senate Agenda Begins to Unfold

Over the last two weeks, lawmakers have largely been on a recess period while the Senate has continued to take steps to organize within the chamber. Elsewhere, leaders in the Senate have drawn attention to the issue of teacher pay while also examining workforce shortages within the healthcare industry. 

HELP Committee Holds Healthcare Shortage Hearing

The Senate Health, Education, Labor and Pensions Committee (HELP) held a hearing on February 16 to examine persistent workforce shortages within the healthcare industry. Witnesses included an array of postsecondary institutional leaders, many of whom emphasized the importance of quality career advisement starting in high school and middle school. The hearing also emphasized the importance of early career exposure, to help put more students on pathways leading to careers in the healthcare industry. Witnesses highlighted the impact of high-quality work-based learning opportunities, particularly apprenticeships, as a useful strategy to meet ongoing workforce challenges in the sector. Senate HELP Committee Chair Sanders Hosts Teacher Pay Town Hall

Last week, Senator Sanders (I-VT) held a town hall with leaders of the two largest teacher unions, as well as Senator Markey (D-MA) along with several teachers, to raise awareness about the issue of teacher pay and to tout forthcoming legislation that would create a nationwide minimum salary for K-12 teachers. “Raising teacher salaries to at least $60,000 a year and ensuring competitive pay for all of our teachers is one of the most important steps we can take to address the teacher shortage in America and to improve the quality of our public school system in America,” Sanders said during the event. Senate Appropriations Committee Takes Shape

Last week, the new Chair joined by the Ranking Member of the Senate Appropriations committee—Senators Patty Murray (D-WA) and Susan Collins (R-ME) respectively— announced the leaders for the individual subcommittees that compose the appropriations committee and oversee federal funding for the 12 spending accounts that make up the federal budget. Of note for the CTE community, Senators Tammy Baldwin (D-WI), co-chair of the Senate CTE Caucus, along with Shelly Moore Capito (R-WV), will serve as Chair and Ranking Member, respectively, of the Labor, Health and Human Services, Education and Related Agencies Subcommittee—the entity that oversees and determines annual investments in the Carl D. Perkins Career and Technical Education Act (Perkins V) and other federal education and workforce programs of interest to the CTE community. More information on the announcement can be found here.

Secretary of Labor Walsh Resigning 

After serving as U.S. Secretary of Labor for the last two years, Marty Walsh has announced that he will be resigning from this position in mid-March. In a goodbye letter to his Department, Walsh acknowledged U.S. Department of Labor Deputy Secretary Julie Su saying, in part, “. . .Julie is an incredible leader and has been central to our success as a team and as a department. With the kind of leadership and talent assembled across the department, I am confident there will be continuity and the work will be sustained.” Walsh is leaving the department to lead the National Hockey League’s Players’ Association as the group’s next Executive Director.

Legislative Update: Bipartisan Spotlight on CTE This Week

This week the President delivered the annual State of the Union Address to a joint session of Congress, while the House held its first hearing of the new 118th Congress. Elsewhere Career Technical Education (CTE) champions in the House introduced a resolution designating February as CTE Month while lawmakers reintroduced legislation that would greatly expand postsecondary CTE opportunities for learners across the country. 

President Biden Delivers State of the Union 

On Tuesday, February 7, President Joe Biden delivered the annual State of the Union address to a joint session of Congress. The speech focused on the President and Congress’ accomplishments over the last two years, including significant investments in advanced manufacturing, the nation’s infrastructure, and other domestic priorities, while also reiterating a need to “finish the job” in the 118th Congress—a recurrent theme that the President returned to throughout the evening. Ahead of the address to the joint session of Congress, First Lady Jill Biden’s guests included Kate Foley– a 10th grade computer-integrated manufacturing student who the First Lady had met last year during a visit she and other Administration officials made to CTE programs in Rolling Meadows High School. In addition, Rep. Glusenkamp Perez (D-WA) brought Cory Toppa, a construction, engineering design, and manufacturing teacher at Kalama High School and the director of CTE for the Kalama school district as her guest during the speech. 

During the speech, the President touched on a wide range of issues, including universal preschool for three- and four-year olds, raising teacher salaries, and calling on Congress to provide greater resources for digital connectivity. However, the President consistently highlighted the centrality of education and workforce development as part of America’s ability to compete within the wider global economy. Notably, the President touched on Career Technical Education (CTE) saying, in part, “Let’s finish the job, and connect students to career opportunities starting in high school, provide access to two years of community college, the best career training in America, in addition to being a pathway to a four-year degree. Let’s offer every American a path to a good career, whether they go to college or not.” 

Reinforcing the Biden Administration’s sincere and growing interest in CTE, U.S. Secretary of Education Miguel Cardona visited high school career academies in Omaha, Nebraska the following day to discuss students’ experiences in these programs. Advance CTE was proud to honor this program as an Excellence in Action awardee in 2015, highlighting the program’s exemplary performance which was on full display as part of the Secretary’s visit this week. As shared by the U.S. Department of Education (USED), the visit was also intended to reinforce Secretary Cardona’s recent speech outlining his Department’s priorities for the coming year, which include a focus on strengthening CTE pathways for students. House Education Committee Hosts First Hearing

The newly renamed House Education and the Workforce Committee, Chaired by Rep. Virginia Foxx (R-NC) held its first hearing this week titled, “American Education in Crisis.” Witnesses included Virginia Gentles, Director of the Education Freedom Center at the Independent Women’s Forum, Colorado Governor Jared Polis, Scott Pulsipher, the President of Western Governors University, and Monty Sullivan, the President of the Louisiana Community and Technical College System. The wide-ranging hearing was intended to highlight aspects of the committee’s likely agenda over the next year ranging from K-12 and postsecondary education to workforce development. During the hearing several CTE topics were discussed at length, including the need to greatly expand postsecondary CTE opportunities by enacting legislation that would expand federal Pell grant eligibility for high-quality, shorter-term CTE programs. 

Hearing witnesses, along with an array of committee members on both sides of the aisle, also voiced support for these much needed reforms to the nation’s postsecondary education system. “The single most important step Congress can take in helping address our nation’s skill shortage is to immediately authorize the use of Pell Grants for workforce programs. . . [I] strongly urge Congress to come to consensus on legislation that, when passed, will enable a significant increase in the number of students across the country who will have a new opportunity in how they improve their skills”  Monty Sullivan shared as part of his testimony. 

Beyond short-term Pell reform, the hearing also touched on the need to reauthorize the Workforce Innovation and Opportunity Act (WIOA) and the Higher Education Act (HEA), most notably by more tightly aligning these federal investments in future legislative updates. In particular, witnesses spoke about the importance of wrap-around services and developing integrated systems of education and workforce development that more effectively ensured learner and worker success. Witnesses also voiced strong support for expanding work-based learning opportunities, particularly  apprenticeship programs and called for a broadening of federal support for multiple postsecondary pathways that lead to opportunity. House Lawmakers Reintroduce the JOBS Act

Late last week, a group of bipartisan lawmakers including Reps. Bill Johnson (R-OH), Lisa Blunt-Rochester (D-DE), Michael Turner (R-OH), and Mikie Sherrill (D-NJ), reintroduced the Jumpstarting our Businesses by Supporting Students (JOBS) Act (H.R. 793)– legislation that would expand federal Pell grant funding eligibility to high-quality, shorter-term CTE programs that meet certain criteria. The bill is the House companion to legislation also reintroduced in the Senate last week, which is currently supported by just under half of the upper chamber. Advance CTE is proud to support this legislation and encourages members to reach out to their Representatives to encourage them to co-sponsor the legislation this Congress. House CTE Caucus Introduces CTE Month Resolution 

On Wednesday, February 8th, House CTE Caucus Co-chairs Reps. Glenn “GT” Thompson (R-PA) and Suzanne Bonamici (D-OR) introduced a resolution recognizing and designating February as National CTE Month (H. Res. 110). The resolution was co-sponsored by a broad bipartisan coalition of 71 Representatives– a new high watermark of support for the annual resolution. Advance CTE and the Association for Career and Technical Education (ACTE) were joined by more than 50 other organizations who also supported the introduction of the resolution this week. 

“We are proud to support the 2023 Career Technical Education (CTE) Month resolution as a celebration and recognition of the impact CTE has for learners as they explore and find their career passions, secure meaningful credentials of value aligned to in-demand careers and provide employers with a highly skilled workforce that is responsive to rapidly evolving industry needs,” said Advance CTE Executive Director Kimberly Green. Senate HELP Organizes

The Senate Health, Education, Labor, and Pensions (HELP) Committee– the entity with responsibility over CTE policymaking in the Senate– met for the first time this week to formally organize and adopt rules for the Congress. New HELP Committee Chair Bernie Sanders (I-VT) emphasized his desire to focus on a wide range of healthcare issues, including a focus on the workforce shortages within the sector. Chair Sanders noted that “We desperately need plumbers and carpenters and electricians and yet we don’t have the training capabilities of doing that.” He highlighted apprenticeships as a potential strategy to address these needs and emphasized that he hoped to work together with Ranking Member Bill Cassidy (R-LA) and his colleagues on these issues in the coming Congress. 

During remarks,  Ranking Member Bill Cassidy (R-LA) emphasized his desire to reauthorize WIOA and HEA, while also identifying reducing the costs of postsecondary education as being another potential area of bipartisan consensus he hoped to pursue over the next two years. The brief organizational meeting also featured high-level remarks from other committee members who highlighted their priorities for the coming Congress. Legislative Update: Lawmakers Introduce Proposals to Expand Pell Grants for CTE Programs as CTE Month Begins

This week lawmakers in both Chambers introduced proposals to expand federal Pell grant eligibility to high-quality, shorter-term Career Technical Education (CTE) programs. Elsewhere, the House and Senate CTE Caucuses are seeking support for a resolution in honor of CTE Month this February. Lawmakers have also finalized committee assignments for entities that will determine CTE funding and policymaking over the next two years.

Short-Term Pell Proposals Introduced

Earlier this week,  Senators Tim Kaine (D-VA) and Mike Braun (R-IN) reintroduced the Jumpstarting our Businesses by Supporting Students (JOBS) Act (S.161)– legislation that would expand federal Pell grant funding eligibility to high-quality, shorter-term CTE programs that meet certain criteria. This legislation has been a longstanding federal priority for Advance CTE as a key way to provide more learners quality postsecondary pathways that lead to jobs in growing sectors of the economy. A bipartisan group of 36 Senators also co-sponsored the legislation upon introduction, underscoring the significant level of support the proposal continues to have in the chamber. Additionally, late last week House Republican Conference Chair Rep. Elise Stefanik (R-NY), Education and Workforce Committee Chair Virginia Foxx (R-NC), along with several Republican colleagues, introduced the Promoting Employment and Lifelong Learning (PELL) Act (H.R. 496)– legislation that also seeks to expand federal Pell grant eligibility for certain short-term postsecondary CTE programs. This legislation differs from the JOBS Act in several ways and is a competing proposal to the bipartisan JOBS Act which is also expected to be reintroduced in the House this Congress. Be Sure to Encourage Congress to Support CTE Month Resolutions!

Co-chairs of the Senate CTE Caucus, Sens. Tim Kaine (D-VA), Todd Young (R-IN), and Tammy Baldwin (D-WI) are currently circulating a resolution designating February as CTE Month. These leaders are asking their colleagues to co-sponsor this resolution and Advance CTE encourages members to reach out to your Senators to encourage them to sign on to this resolution as soon as possible. 

Concurrent to these efforts, House CTE Caucus co-chairs Reps. Thompson (R-PA) and Bonamici (D-OR) are also circulating a resolution in the chamber for this same purpose and are seeking co-sponsors ahead of planned introduction on February 8th. However, the resolution will be open throughout the month to add more co-sponsoring members ahead of planned passage at the end of the month. Both of these resolutions are important ways in which CTE can be elevated amongst federal policymakers and allows Advance CTE and the Association for Career and Technical Education to continue to highlight the benefits CTE programs provide for learners and the need to continue to invest in these efforts. 

House Education Committee Lays Out Vision for New Congress

The newly renamed Education and the Workforce Committee—the House entity responsible for CTE policymaking—has continued to take important steps this week to organize and map out an agenda for the 118th Congress. Earlier in the week, House Democrats, led by Ranking Member Bobby Scott (D-VA), announced committee assignments for the new Congress. This comes after Committee Chair Virginia Foxx (R-NC) announced her party’s members slated for the committee last week. Following these necessary first steps, Chair Foxx held an organizing meeting this week where the committee adopted a set of rules and a related oversight plan for the coming year. 

“Oversight will be a major priority for this Committee in the 118th Congress. . . Federal agency heads might as well get comfortable with this hearing room—they are going to be here a lot” Chair Foxx said, in part, at the outset of the meeting. The oversight plan includes a wide range of issues that will likely be focused on by the committee this Congress including an examination of how pandemic relief funding for education was used, as well as several workforce programs authorized by the Workforce Innovation and Opportunity Act (WIOA). In a separate interview this week, Chair Foxx also shared that she plans to prioritize higher education and workforce development legislation this Congress and is hopeful about finding consensus on short-term Pell grant proposals outlined above. Committee leadership has also shared that the Education and Workforce Committee will hold its first hearing of the new Congress titled, “American Education in Crisis”, scheduled for February 8th. 

Senate Organization Take Shape

On the other side of the Capitol, the 118th Congress has gotten off to a slower start than the House. This has been due, in part, to efforts to determine where newly elected Senators would be assigned for the coming Congress, particularly amongst Republicans who have six new members joining the caucus this year. Late last week, Majority Leader Chuck Schumer (D-NY) announced committee assignments for Democrats, including for the Health, Education, Labor, and Pensions (HELP) Committee—the entity with responsibility for K-12 education policymaking. 

Of note, Sen. Bernie Sanders (I-VT) will chair the HELP committee, replacing longtime Chair Sen. Patty Murray (D-WA) who will be leading the Appropriations Committee in the new Congress. In addition, Sen. Ed Markey (D-MA) will be joining the HELP Committee this Congress, filling a vacancy left by Sen. Jackie Rosen (D-NV) who has been assigned elsewhere. Minority Leader Mitch McConnell (R-KY) similarly announced assignments for committees in the upper chamber this week, including HELP. Sens. Legislative Update: Senate Pares Back CHIPS, While Biden Administration Highlights ARP Impact and Cybersecurity Workforce Needs

This week the Senate advanced more modest economic competitiveness legislation after deliberating on the proposal for more than a year. Elsewhere, the Biden Administration drew attention to workforce challenges in the cybersecurity space, while the U.S. Department of Education (ED) unveiled new school discipline guidance while Secretary of Education Miguel Cardona and First Lady Jill Biden highlighted ongoing efforts to help learners recover from the impacts of the coronavirus pandemic. 

Senate Advances More Modest CHIPS Proposal

After over a year of consideration, Senate Majority Leader Chuck Schumer (D-NY) introduced a measure late Tuesday night, July 19, that formally began debate on economic competitiveness legislation intended to bolster the nation’s advanced manufacturing capacity in critical sectors of the economy related to the production of semiconductor chips. Currently known as “CHIPS+,” earlier iterations of this legislation, introduced in both the House and the Senate separately over the last year and a half, included significant new funding in education and workforce development. In particular, lawmakers had hoped to include an expansion of the federal Pell Grant Program to include high-quality, shorter-term CTE programs. Known elsewhere as the JOBS Act, this proposal would be key to cultivating the skilled workforce necessary to make investments envisioned under this legislation successful. Senator Rob Portman (R-OH)– a key negotiator for the current CHIPS+ proposal and a long-time co-sponsor of the JOBS Act– recently highlighted the urgent need to enact this reform to the federal Pell grant program.

Despite these ongoing legislative efforts, lawmakers have remained unable to find consensus on these and many other provisions that were under formal consideration as part of a bicameral and bipartisan conference negotiation. As a consequence, the legislation currently under consideration in the Senate has been pared back considerably and does not include many of the provisions, like the JOBS Act, that Advance CTE believes are urgently needed. If enacted, however, the bill would create several new grant programs aimed at preparing students to enter into STEM and computer science fields, while also providing significant new subsidies to semiconductor manufacturers and designers. The measure was procedurally advanced on a bipartisan basis, 64-34 and will be considered by the Senate further next week.

Biden Administration Highlights Cybersecurity Workforce Needs

On Tuesday, July 19, the Biden Administration convened a National Cyber Workforce and Education Summit to highlight the ongoing and urgent need to create and prioritize career pathways programs that lead to careers in cybersecurity. As part of the summit, the U.S. Departments of Labor and Commerce announced a new initiative aimed at bolstering and expanding apprenticeship programs to prepare individuals for careers in cybersecurity. This “120-day Cybersecurity Sprint” is intended to promote existing registered apprenticeship programs and support the creation of new programs aimed at addressing this urgent labor shortage. ED Releases New School Discipline Guidance

ED unveiled new guidance on Tuesday, July 19, for states and school districts to help K-12 education leaders address longstanding disparities in discipline for learners with disabilities. The guidance follows a 2018 Government Accountability Office (GAO) report which found that learners with disabilities, particularly learners of color, face disproportionate rates of school discipline as compared to their peers. The guidance re-emphasizes the requirements of Section 504 of the Individuals with Disabilities Education Act (IDEA) while highlighting best practices regarding implementation. Secretary Cardona, First Lady Biden Launch Pandemic Relief Tour

Earlier this week, U.S. Secretary of Education Miguel Cardona and First Lady Jill Biden announced a joint. nationwide tour. In the coming days, the duo plan to highlight the impact of the American Rescue Plan (ARP) in helping students recover from the impacts of the pandemic, recover from lost instructional time, and provide enrichment and academic opportunities during the summer months. In particular, Cardona and Biden aim to emphasize how the $122 billion in ARP funding has helped more learners access out-of-school and summer enrichment programs as a means to accelerate learning. Legislative Update: Secretary Cardona Testifies and Makes State CTE Visit

Over the last two weeks U.S. Secretary of Education Miguel Cardona testified before House appropriators while also leading several efforts to celebrate the importance of teachers and promote much-needed reforms to the Pell Grant program. Elsewhere, lawmakers introduced legislation to attract and retain a robust teacher workforce while the U.S. Secretary of Labor and the Chairman of the House Education and Labor Committee highlighted the importance of workforce development and apprenticeship programs. 

Secretary Cardona Testifies on FY23 Budget

On Thursday, April 28, U.S. Secretary of Education Miguel Cardona testified before the House Appropriations Subcommittee on Labor, Health and Human Services, Education, and Related Agencies regarding the Biden Administration’s 2023 federal fiscal year (FY23) funding requests for programs overseen by the U.S. Department of Education (ED). This hearing is part of wider, ongoing efforts in Congress to consider aspects of President Biden’s FY23 budget request released a few weeks ago. During his formal testimony, Secretary Cardona focused on the need to close opportunity and achievement gaps by investing more in educational programs, addressing student mental health needs, growing the educator workforce, and building creative on-ramps to more affordable college and career pathways. During the hearing, lawmakers discussed a wide range of issues, including STEM education and lingering stigmas attached to “skilled trades” instruction. Although the Carl D. Perkins Act’s (Perkins V) basic state grant program was not mentioned explicitly during this hearing, House CTE Caucus co-chairs Reps. Langevin (D-RI) and Thompson (R-PA) successfully led a Dear Colleague letter calling for robust funding for this program ahead of Cardona’s appearance. Nearly a third of Representatives in the House, 127, signed on in support of this letter– a reflection of the strong support the program has in Congress. 

Lawmakers Introduce RAISE Act 

Coinciding with national Teacher Appreciation Week, Sen. Booker (D-NJ) and Rep. Schiff (D-CA) introduced the Respect, Advancement, and Increasing Support for Educators (RAISE) Act– legislation that, if enacted, would provide a sliding scale of refundable annual tax credits specifically for teachers. Tax credit amounts would be determined by school poverty levels where teachers work. Importantly, CTE instructors who meet state certification requirements would be eligible for up to $15,000 in tax credits. Advance CTE is proud to endorse this legislation and urges its swift enactment to help address persistent teacher shortages across the country. More information on the proposal can be found here

Cardona Promotes Pell Grant Modernization 

Secretary Cardona attended an event celebrating Second Chance Month last week, where ED announced it had invited 73 postsecondary institutions to participate in the third round of the Second Chance Pell Experiment– an effort that expands access to Pell grants for incarcerated individuals. During this event Secretary Cardona also expressed support for the expansion of the Pell Grant program for high-quality short-term CTE programs. As a reminder, lawmakers in Congress are debating whether to include a short-term Pell Grant program provision as part of wider conference negotiations over economic competitiveness legislation. Recently the Senate held a series of procedural votes to formally begin this negotiation process. Advance CTE has continued to advocate in favor of this change which is modeled after legislation long sponsored by Sens. Kaine (D-VA) and Portman (R-OH). 

ED Celebrates Teacher Appreciation Week 

This week commemorates Teacher Appreciation Week—a time to honor the contribution of teachers nationwide. As part of these efforts,. Secretary Miguel Cardona kicked off the week with a visit to Richmond, Virginia to tour high school and postsecondary CTE programs with Sen. Tim Kaine (D-VA). The event also included a visit to Richmond’s Teacher Residency Program which aims to attract and retain teachers in high-needs subject areas. Later in the week, Cardona hosted a roundtable further celebrating teachers and the invaluable contributions that they make each day. At this event, the Secretary discussed a public service loan forgiveness waiver announced last fall aimed at discharging student debt carried by eligible teachers.

Legislative Update: House Advances WIOA Proposal

This week the House Education and Labor Committee marked up legislation to reauthorize the Workforce Innovation and Opportunity Act (WIOA) while the Senate considers additional pandemic aid legislation with implications for postsecondary institutions. In addition, Advance CTE continues to encourage its members and partners to support legislation to improve learner access to Pell Grants for high-quality, short-term postsecondary Career Technical Education (CTE) programs. Finally, be sure to encourage your Senators and Representatives to join the House and Senate CTE Caucuses if they have not already done so! 

House Democrats Release WIOA Reauthorization Proposal 

Since last spring, Congressional lawmakers have been considering and debating making updates to WIOA– federal legislation that funds the nation’s workforce development system. Last week, Democrats on the House Education and Labor Committee released a comprehensive proposal to reauthorize this law dubbed the Workforce Innovation and Opportunity Act of 2022 (H.R. 7309). On Tuesday, April 5, the committee held a hearing to markup this legislation, considering and debating amendments to this proposal. An updated version of the legislation, known as an amendment in the nature of a substitute (ANS), was considered and ultimately adopted by the committee along party lines. This ANS made several small changes to the underlying legislation first released last week, including by adding digital literacy efforts as an allowable usage of WIOA youth funding. 

Broadly, Democrats were supportive of H.R. 7309 and highlighted aspects of the proposal that they either directly sponsored or generally supported. Republicans were broadly unsupportive of the proposed legislation, instead favoring a separate ANS proposal put forward by Rep. Miller-Meeks (R-IA). Republicans on the committee proposed several amendments to H.R. 7309, including this alternative proposal, which were all defeated along party lines. Following several hours of debate, the Committee passed H.R. 7309 by a margin of 29-21. This vote advances the legislation out of committee for further consideration by the full House chamber with a floor vote tentatively expected later this spring. 

Ahead of the markup, Advance CTE and the Association for Career and Technical Education (ACTE) sent a letter to the committee, applauding certain aspects of the legislation, particularly the bill’s approach to the sharing of one-stop center infrastructure costs. The letter went on to note that work lies ahead to further refine and improve on this proposal. Despite the encouraging progress on WIOA taking place in the House, it remains unclear whether comparable activity will commence in the Senate. As these efforts continue to unfold, Advance CTE and its partners will continue to work with lawmakers to make updates to this important law aligned with the organization’s newly updated recommendations for this legislation. 

Lawmakers Consider Higher Education Recission

For the last few months, Congress and the Biden Administration have been grappling with how to pass additional legislation to fund pandemic response activities, such as the purchasing of testing kits, vaccines and additional therapeutics. Broadly, Republicans and Democrats have continued to disagree on how to pay for this supplemental funding package. Recently, a group of Senators has coalesced around a $10 billion package for this purpose. However, as part of this emerging agreement, Republicans have insisted that this be paid for using unspent pandemic aid dollars. Nearly $500 million in Higher Education Emergency Relief funds (HEERF) would likely be used to defray some of the total $10 billion cost of the package. A summary of the agreement can be found here. A timeline for the advancement and passage of this legislation remains unclear.  

Lend Your Support to Pell Grant Modernization 

Advance CTE and its partners have continued to advocate for the enactment of the Jumpstart Our Businesses by Supporting Students (JOBS) Act – legislation that would make long-overdue improvements to the federal Pell Grant program by expanding eligibility for high-quality shorter-term postsecondary CTE programs. As lawmakers continue to negotiate and craft forthcoming legislation to improve the competitiveness of the American economy, this reform would drastically enhance the nation’s ability to provide pathways for workers and learners to earn valuable postsecondary credentials needed in today’s economy. 

To help ensure lawmakers understand the importance of this legislation and the role it has in ensuring American global economic competitiveness, Advance CTE encourages state and local CTE affiliates, especially nonprofit CTE institutions, to sign-on in support of this letter ahead of anticipated legislative action later this year.

Legislative Update: Advance CTE and ACTE Host Congressional CTE Month Briefing

This week the Advance CTE and ACTE co-hosted a Congressional briefing with Career Technical Student Organizations, while over two-thirds of the Senate supported a resolution designating February as Career Technical Education (CTE) month. The Senate HELP Committee also held a briefing exploring issues impacting workforce development while lawmakers worked to extend current funding levels through mid-March. In addition, the FCC announced the disbursement of additional connectivity funding while the U.S. Department of Education (ED) made important updates to its College Scorecard.

Advance CTE and ACTE Host Congressional CTE Month Briefing 

On Tuesday, February 15, Advance CTE and the Association for Career and Technical Education (ACTE) hosted a bicameral Congressional briefing featuring learners from several Career Technical Student Organizations (CTSOs): 

Moderated by Advance CTE’s Executive Director Kimberly Green, the briefing highlighted the value of CTE and elevated CTSO learner experiences from both K-12 and postsecondary perspectives. The event also featured remarks from CTE Caucus Co-chairs Rep. Jim Langevin (D-RI) and Sen. Todd Young (R-IN). During Rep. Langevin’s opening comments, the long-time House CTE Caucus co-chair noted, in part, that “A dependable, skilled, and prepared workforce is more critical to our economy than ever, and CTE lays the foundation for students to succeed both now and in the future.” Sen. Young emphasized his ambitions to grow CTE opportunities throughout the nation by co-chairing the Senate CTE Caucus noting that, “3 of 5 jobs in Indiana require more than a high-school diploma but less than a four year degree. More than half of workers in the state do not yet have this level of education.”

Following these remarks from congressional CTE champions, Green posed a series of questions to the CTSO student panel. For Deddens, the FCCLA First Vice President noted that “. . . being a national officer has allowed me to advocate for change in community and state and meet people of diverse backgrounds, cultures and beliefs. Being in CTSOs opens these lines of communication.” National TSA President Rangu noted the impact her first national TSA convention had on her, noting “It was empowering for me to see someone that looked like me [be a national leader] so I felt confident to step into that position and serve as a role model for others.” Tyagi, HOSA’s International President Elect, emphasized the importance of his mentors noting “…[they]  instilled the importance of giving back to communities to secure a future of health that has no boundaries and will take care of every individual.” DECA Collegiate President Spohn emphasized how CTE was “. . . the first time I was in a classroom where what I was being taught was applicable to what I wanted to do with my life and career.”

Senate Passes CTE Month Resolution With Overwhelming Bipartisan Support

In the evening following the CTSO panel, the Senate considered a bipartisan resolution designating February as CTE Month. The Senate unanimously passed this resolution without objection which garnered the support of over two-thirds of the Senate with 68 total co-sponsors. In a speech just before the resolution’s passage Senator Kaine (D-VA), the lead sponsor of the resolution remarked , “By formally recognizing CTE Month through this resolution, we hope to bring greater awareness to improving access to high-quality career and technical education for millions of America’s students and our Nation’s ongoing economic competitiveness.” The House recently introduced a similar resolution and is in the process of recruiting additional co-sponsors. Senate HELP Committee Holds Workforce Development Hearing 

On Tuesday, February 15, the Senate Health, Education, Labor, and Pensions (HELP) Committee held a hearing to examine workforce development policies and related strategies collectively aimed at helping workers find and obtain family sustaining employment. The hearing focused particularly on individuals with barriers to employment and the value and impact wraparound support services–like childcare, transportation, and career navigation supports–have in helping workers overcome these existing challenges. 

During the question and answer portion of the hearing, Sen. Tim Kaine (D-VA) highlighted his and Sen. Rob Portman’s (R-OH) ongoing sponsorship of the JOBS Act– legislation that, if enacted, would provide Pell Grants for high-quality, shorter-term training programs at postsecondary institutions to more effectively support workers and learners. Advance CTE has long supported this legislation and continues to call for its enactment by Congress this year. Congress Passes FY22 Funding Extension Through Mid-March 

The formal start of the current federal fiscal year 2022 (FY22) began on October 1, 2021. Since that time, lawmakers in Congress have been unable to come to agreement on full-year funding for the current 2022 federal fiscal year (FY22). Congress has passed a series of short-term funding measures—known as a continuing resolution (CR)—to extend current FY21 funding levels through FY22. To date, these actions have averted a federal government shutdown and lapse in appropriations for laws like Perkins V. However, the most recent of these CRs is set to expire February 18, 2022. 

Last week, lawmakers in the House passed another CR to extend current funding levels, yet again, for federal operations and programs through March 11. This measure passed the chamber by a margin of 272-162 and is intended to provide lawmakers additional time to work out a full-year funding agreement for FY22. Late last night, the Senate followed suit passing the legislation by a margin of 65-27. Focus now turns back to Congressional appropriators who are reportedly working to finalize full-year funding for programs like Perkins V’s basic state grant program. As these efforts unfold, Advance CTE will continue to advocate for a comprehensive FY22 funding bill and a robust investment for the CTE. 

ED Makes Updates to College Scorecard

Last week the U.S. Department of Education (ED) announced several enhancements to the College Scorecard broadly aimed at making it more useful for prospective learners and their families. Among the changes made is a new earnings threshold metric, which shows the percentage of former students whose earnings exceed those of the average high school graduate. This measure is intended to demonstrate a return on investment for entering postsecondary education. A similar measure is currently being considered as part of forthcoming changes to “gainful employment” rules which ED is currently negotiating with stakeholders. A recent examination of these updated College Scorecard data by Georgetown’s Center on Education and the Workforce found that more than half of students at roughly 30 percent of postsecondary institutions earn less than a high school graduate after 10 years. 

FCC Announces Ninth Wave of Emergency Connectivity Fund Commitments

Last week the Federal Communications Commission (FCC) announced a ninth wave of funding commitments totaling over $125 million as part of the Emergency Connectivity Fund (ECF). The $7.2 billion ECF program was authorized as part of the American Rescue Plan and allows eligible schools and libraries to apply for financial support to purchase connected devices like laptops and tablets, Wi-Fi hotspots, modems, routers, and broadband connectivity to serve unmet needs of students, school staff, and library patrons at home during the ongoing pandemic. Securing initial funding for the ECF was one of Advance CTE’s legislative priorities since the beginning of the COVID-19 pandemic. This round of commitments will support 270,00 students by providing funding to over 340 schools, 20 libraries, and 6 consortia who are set to receive 330,000 connected devices and over 39,000 broadband connections. President Trump’s First Week in Office

Trump Freezes Pending Regulations, Including those Related to ESSA Accountability

President Donald J. Trump was sworn into office on Friday. During the inauguration ceremony, the President said the U.S. has “an education system flush with cash, but which leaves our young and beautiful students deprived of all knowledge,” though he did not provide additional details about his plans for improving the federal education system.

Upon taking office, Trump immediately revoked any regulations not yet submitted to the Federal Register and postponed the effective date of pending regulations by 60 days. This echoes a similar move from the Obama administration in early 2009. Although the most recent round of ESSA regulations, which detail accountability and state plans, were published in November 2016, they were not set to take effect until January 30. As a result, those regulations will now go into effect on March 21, 2017. While this could implicate ESSA plan submissions, state officials and consultants do not anticipate the pause will affect state timelines, according to Education Week.

President Trump has also hinted that he wants to reduce federal regulations by 75 percent, though he has not indicated where these reductions will come from.

Lastly, positions at the White House are starting to be filled. Rob Goad, a former staff with Rep. Luke Messer (R-IN) has been selected to fill the position of Education Advisor at the Office of Domestic Policy Council.  The Education Advisor position is not a “required” position, so the fact that the position has been filled early on is a potential signal of the administration’s intent to develop education policy priorities.

DeVos Vote Rescheduled to January 31

Last week we provided an overview of Education Secretary to be Betsy DeVos’s hearing with the Senate Health, Education, Labor and Pensions (HELP) Committee. While questions related to Career Technical Education (CTE) or reauthorization of the Carl D. Perkins Act of 2006 were limited, the hearing turned out to be quite contentious, with Democrats protesting the limited time to review the nominee’s ethics report prior to a confirmation vote. Responding to concerns from his committee, Chairman Lamar Alexander (R-TN) postponed DeVos’s hearing by one week to Tuesday, January 31 to allow Senators additional time to review the Office of Government Ethics’ report. On Friday, Senator Todd Young (R-IN)  recused himself from voting on the DeVos confirmation, citing a conflict of interest because she donated to his campaign.

Senators Kaine and Portman Reintroduce JOBS Act

On the Hill, Senators Tim Kaine (D-VA) and Rob Portman (R-OH), co-chairs of the Senate CTE Caucus, reintroduced the bipartisan Jumpstart Our Businesses by Supporting Students Act of 2017 (JOBS Act). The bill aims to expand the Federal Pell Grant program to include postsecondary CTE job training programs in in-demand industries. Under the bill, such programs must provide no less than 150 clock hours of instructional time over eight weeks and enable students to obtain a license or credential. Advance CTE has endorsed the proposed legislation.

WIOA Infrastructure Guidance

On January 18, 2017, Former Acting Assistant Secretary John Uvin, put out an extensive memo articulating additional information related to the Workforce Innovation and Opportunity Act (WIOA) infrastructure guidance. While the memo was directed to State Directors of Adult Education, Perkins is mentioned throughout. Advance CTE is in the process of analyzing the memo and will provide a more in depth analysis to members next week. We should note that it is unclear whether any of the non-regulatory guidance put forth by the Obama Administration will hold, given the Trump Administration’s push to reduce federal oversight and burden on states by reducing regulations.
