State CTE Policy Update: Exploring Louisiana’s Back on Track Pilot Program for Justice-Connected Learners

State Career Technical Education (CTE) policy initiatives and programs vary across the nation; innovations across states can offer helpful insights for state CTE leaders to continue to support each learner’s path to success in the career of their choice without limits.  

This post provides an overview of Louisiana’s recently enacted Act 370 (H.B. 323) 2022 Regular Session, known as the “Back On Track Louisiana Pilot Program”, and how it connects with CTE programs to support justice-connected individuals.

The “Back On Track Louisiana Pilot Program” aims to reduce recidivism in Louisiana by offering incarcerated individuals the tools they need, such as driver’s licenses and bank accounts, to skillfully navigate their reentry into the workforce. It also provides a CTE funding mechanism and establishes a mandate for data accountability within correctional education spaces.

Program Background 

This legislation stands out as an innovative means to not only incentivize high-quality correctional education programs by rewarding outcomes with additional funding. It allows for the flexibility needed to make the program effective for individual populations and meet each program’s needs. With the appropriate connections between state agencies such as the Louisiana Community and Technical College System (LCTCS) and the Louisiana Workforce Commission (LWC), the Department of Public Safety and Corrections (DPSC) can leverage industry partnerships and maximize the effectiveness of the credential programs they offer within their correctional facilities. 

With the “Back On Track Louisiana Pilot Program”, justice-involved learners who are incarcerated will have the opportunity to earn multiple credentials of value that align with Louisiana’s Industry Based Credential (IBC) Focus List compiled by the Louisiana IBC Council. These credentials of value ensure learners are prepared for high-skill, high-wage, in-demand occupations that support the future workforce of the state. This effort aligns with other funding mechanisms to support correctional education and high-quality programs such as the state’s utilization of Strengthening Career and Technical Education for the 21st Century Act (Perkins V) federal funds. In Louisiana, the state allocates a portion of its Perkins funds to DPSC to ensure learners experiencing unique circumstances such as incarceration have access to relevant workforce education and training. Offering learners in correctional facilities the opportunity to explore career pathways will not only allow them to reenter the workforce and their communities as a whole but will also strengthen CTE programming in an often overlooked population.

Funding Flexibility 

The legislation provides guidelines for funding and accountability while also establishing a framework for sheriffs to personalize their programs. The language of the law requires jails and prisons to collect the information of participating incarcerated and paroled individuals regarding specific success metrics. While these metrics track measures for these individuals to successfully reintegrate into their communities, there are several explicitly targeting CTE initiatives, namely whether the inmate: 

To ensure each sheriff has a scalable funding system for their program, DPSC calculates half of the average number of days of incarceration of the enrolled individual multiplied by the amount the Department pays the sheriff each day for the housing of inmates in parish jails. As an additional incentive for the successful execution of the program, sheriffs will receive a bonus stipend per incarcerated individual based on the percentage of targets successfully attained. Funds will be used for equipment, instructional materials and instructors, allowing smaller programs to flourish as well as larger programs. 

Program Customization 

Authority for this legislation is housed at the DPSC, which already offers ten programs eligible for Perkins V funding: Automotive Technology, Building Technology, Carpentry, Collision Repair, Construction Project Management, Electrician, Heavy Equipment Operator, HVAC, Small Engine, and Welding. The prison system has employed a method to train and hire correctional facility instructors for the Industry Based Credential (IBC) classes offered at each facility. Each participating facility ensures that all justice-connected tutors/instructors remain up to date in their training by providing funding to renew all pertinent certifications, as needed. CTE instructors are supervised by a prison education coordinator who is responsible for maintaining the cohesiveness of the entire education department.

State Policies Impacting Industry-Recognized Credentials

State education agencies, legislators and educators faced significant challenges from the coronavirus pandemic, including adapting to remote and hybrid delivery of hands-on learning, and responding to local and national skilled labor shortages. The number of state-level CTE policies enacted that affect Career Technical Education (CTE) fell to the lowest number in 2020 since Advance CTE and the Association for Career and Technical Education (ACTE) began publishing these annual Year in Review reports.

However, with a new commitment to upskilling and reskilling American learners and a CTE without limits, 41 states enacted 138 policies impacting CTE and career readiness in 2021. Advance CTE and ACTE have witnessed the return of pre-pandemic numbers in state policy actions in 2021 with policies affecting the secondary, postsecondary, adult and/or workforce systems, and including legislation, executive orders, and budget provisions that significantly changed funding.

Each year, Advance CTE and ACTE publish a yearly state policy tracker and categorize each state policy action by topic. In 2021, the top five topics that state policy most frequently addressed were:

Industry-recognized Credentials
Policies that address the attainment of credentials recognized by industry, including micro-credentials, such as badges, and educational Degrees are categorized by this topic. Nineteen states enacted 33 policies affecting industry-recognized credentials. Policies in this area are designed to increase or incentivize the attainment of certifications, credentials or degrees aligned with labor market information or industry need. Below are a few state policy actions from this category:

Highlighting Equity in State Policy

State leaders, particularly state legislators, have a unique role to play in ensuring equitable access to high-quality Career Technical Education (CTE). As the COVID-19 pandemic continues, access and technology gaps have been laid bare, revealing inequities in opportunities for marginalized learner populations. While policies addressing access and equity concerns remained a high priority for legislators in years past, 2021 has been no different; this year to date, almost 30 pieces of state legislation have passed in 17 states addressing this issue. Enacted policies focus on elevating learner voice, examining historically inequitable systems and removing barriers to entry, or providing financial support for historically underrepresented populations. The following policies represent a small sample of equity-focused policies already passed in 2021:

State Policies Impacting CTE: 2020 Year in Review

On the state and federal level, COVID-19 (coronavirus) fundamentally changed the conversation about education, significantly disrupting and refocusing state legislatures. Despite this, Career Technical Education (CTE) adapted to the challenges brought about by the coronavirus, continuing to deliver high-quality programming nationwide across all learner levels despite significant disruptions to education delivery. Because the pandemic was on the forefront of federal, state and local governments’ agendas, fewer policies and budget provisions for CTE were enacted than in previous years; in calendar year 2020, 31 states enacted or passed 67 policy actions related to CTE and career readiness.

Today, Advance CTE and the Association for Career and Technical Education (ACTE) released the eighth annual State Policies Impacting CTE: Year in Review report, examining 2020 legislation, executive orders and budget provisions that significantly changed funding. With research support from the Education Commission of the States, Advance CTE and ACTE reviewed state activity, cataloged all finalized state policy actions and coded activity based on the policy areas of focus. In 2020, states most frequently addressed the following topics: 

The policy areas that states focused on in 2020 were similar to previous years. In 2019, funding, industry partnerships and work-based learning and access and equity were also in the top five key policy trends; however, in 2020, dual/concurrent enrollment, articulation and early college and data, reporting and/or accountability replaced industry-recognized credentials and governance in the top five key policy trends. Many CTE relevant bills and budgets, including those that increased state funding for CTE, were passed before the pandemic. However, due to unforeseen spending cuts, many state budgets (or supplemental budgets) enacted this year decreased state CTE funding for FY2021. This trend is expected to continue and even worsen as economic challenges continue for many states. 

States have found creative ways to keep support for CTE at the forefront of their legislative agenda. Some states, like Louisiana, have already appropriated state funding for rapid response training to assist employers with training and reskilling that will result in quickly acquired industry-recognized credentials. Arizona, Delaware, Mississippi, and Ohio have all also enacted legislation creating programs to bolster work-based learning and workforce development programs strengthening learners, workers, and employers alike. Finally, states like Tennessee have relaxed requirements or sponsored wrap-around supports to strengthen CTE and dual enrollment programs. 

Because of the critical importance CTE plays in workforce and economic development, it is expected that more CTE-related policies will be enacted in the coming years to support up-skilling and reskilling efforts during economic recovery. Louisiana piloted the Building Employment Skills for Tomorrow (BEST) program in 2018 to expand work-based learning opportunities for learners with disabilities. The BEST program connects learners with disabilities to work-based learning opportunities, equips them with real-world skills through training and provides mentorship to program participants. Louisiana continues to ensure learners with disabilities have the support necessary to participate and succeed in meaningful work-based learning and career readiness activities.

To assist state leaders in developing and expanding equitable youth apprenticeship programs, the National Alliance for Partnerships in Equity (NAPE) and the Partnership to Advance Youth Apprenticeship (PAYA) has developed a new toolkit, Equity in Youth Apprenticeship Programs

DAY OF ACTION OF THE WEEK

Many took to social media to advocate for the next COVID-19 (coronavirus) relief package to include funding for the E-rate program. You can take action, today, by emailing your members of Congress addressing the need for the inclusion of the Emergency Educational Connections Act (S. 3690/H.R. 6563). 

APPRENTICESHIP PROGRAM OF THE WEEK

Earlier this year, one Florida college was awarded the opportunity to expand their current apprenticeship program into new territories. College of the Florida Keys (CFK) will now offer Construction Technologies, Plumbing and Carpentry, Electrical and HVAC and Electrical and Carpentry as new apprenticeship programs at varying locations beginning this fall. CHALLENGE OF THE WEEK

The U.S. Department of Education invites high schools and local educational agencies to propose technology education programs that use competency-based distance learning. Finalists will be chosen to develop, implement and evaluate their programs. A panelist of judges will convene to select an overall competition winner and award an additional $100,000. The Rural Tech Project is open to any publicly funded school or local educational agency that delivers education to a rural community and to students in grades 9-12.

Putting Afterschool to Work: Impactful Work-based Learning in New Orleans

The destruction of Hurricane Katrina in 2005 transformed New Orleans into a place where construction is not just a high demand, high-wage career, but an act of service to the community. unCommon Construction (UCC)—a non-profit organization in New Orleans that delivers afterschool programming and weekend on-site apprenticeships—engages high school students in career pathways within the construction industry, while also building and selling essential market rate homes for residents and families in the students’ home town.

UnCommon Construction provides high school students with the opportunities to gain over 100 paid internship hours per semester in on-site, hands-on work based learning in the construction trades, through partnerships with area schools and the Louisiana statewide CTE program known as Jump Start. UCC student apprentices engage in trainings after school and spend the weekends building a home in their community alongside construction industry experts including architects, engineers, carpenters, electricians, realtors, title attorneys and more. As UCC Founder Aaron Frumin puts is, “the need in this industry is so broad and widespread, there really isn’t a one-size-fits-all approach.”

UCC programming utilizes the flexibility of the afterschool hours to emphasize the development of communication and teamwork skills, also known as employability skills, to compliment the work-based learning opportunities students receive on the job site.  During afterschool hours, students participate in a leadership development series called “Framing Character,” and are evaluated using a third-party evaluation tool known as a Hirability Scorecard, developed by MHALabs.org. A student who progresses well through the rubric receives an end-of-program endorsement shared with industry partners upon graduation.

The program prides itself on the success of its completers. Eighty percent of students who enroll in the rigorous program complete their semester. Of those who complete their term, 100 percent have remained on track for high school graduation and gone on to either further their education or acquired a job within three months of graduating high school. Remarkably, UCC has been incredibly successful in engaging nontraditional student populations. While the construction industry is 8 percent female about 40 percent of program participants are female or non-gender conforming.

UCC’s model requires a close collaboration with the schools it partners with, often working directly through a college and career counselor or internship coordinator. The school will inform students about the availability of the UCC program, then assist students with writing their applications, acquiring work permits, soliciting letters of recommendation and preparing for their in-person interviews. Once a student is enrolled as a participant, the UCC program reports attendance and progress back to the school so that the school may assign internship credit. UCC also recognizes that students benefit from individual relationships with the mentors in their program, and has established partnerships with schools to provide students with wrap-around support during the school day during identified intervention times to help the student stay on track for high school graduation and career success.

How Louisiana Supports Programs Like unCommon Construction

Afterschool programming and work-based learning in Louisiana is strengthened by state policy and funding. Louisiana’s statewide Jump Start initiative ensures the high school accountability system credits schools equally for work preparing students on quality pathways to college or career. Through Jump Start, students can earn a career diploma by completing industry-based credentials, and career experiences/internships are considered a core element of a high-quality secondary CTE program. As UCC director Aaron Frumin puts it, “college and workforce pathways are equally prestigious.”

Additionally, schools can draw down state dollars through the Career Development Fund to support students with unCommon Construction’s year-long programming. The fund provides financial resources to schools to support career development activities, including transportation to work-based learning sites, insurance, tools and gear, training by career professionals and the 100-120 hours of work based learning. UCC’s non-profit program then leverages funding from the houses it sells back into the community along with funding from philanthropic partners to provide every participating student with hourly pay above the minimum wage for their work and training.

Leveraging Perkins V to Strengthen Afterschool Work-based Learning

State leaders have a number of levers to strengthen and expand work-based learning through the Strengthening Career and Technical Education for the 21st Century Act (Perkins V), the new federal law for Career Technical Education (CTE). States can use Perkins V to foster meaningful partnerships with afterschool programs and other intermediaries to ensure all students can access meaningful work-based learning opportunities, especially when paired with programs that support student employability skills and wraparound supports to see students through a successful graduation and onto the next step in their college or career path.

For one, Perkins V gives states the opportunity to hold local recipients accountable for delivering work-based learning through the secondary CTE program quality indicator. States can choose between three different measures for the accountability indicator, and many are choosing to prioritize work-based learning. As a result of this shift, work-based learning—during and after school hours—is expected to become a more integral part of the CTE experience.

Second, Perkins V funds can be used at the state and local level to support the establishment and expansion of work-based learning opportunities for students. Local funding decisions will be driven by a new Comprehensive Local Needs Assessment, which can surface gaps in work-based learning opportunities and give local leaders direction to help expand offerings for students.

Finally, the law’s emphasis on systems alignment encourages CTE leaders to coordinate with other state agencies to support career development and workforce training for learners. This opens the door for meaningful collaboration with Every Student Succeeds Act (ESSA) and Workforce Innovation and Opportunity Act (WIOA) coordinators, who can align afterschool, youth workforce and career pathways programs.

Strengthening Career Readiness Systems through New Skills for Youth: A Look Back at States’ Impact

Under Kentucky’s new program approval and review process, schools and districts can use state and federal funding to support career pathways only if their programs are aligned with priority industries or top occupations. This is just one of the strategies Kentucky used under the New Skills for Youth (NSFY) initiative to transform and phase out virtually every career pathway that was not well aligned with labor market demand.

From 2016 through 2019, Kentucky and nine other states in the NSFY initiative received $2 million and hands-on technical assistance and coaching to strengthen their career readiness systems. As part of the NSFY initiative, a $75 million national initiative developed by JPMorgan Chase & Co, the Council of Chief State School Officers, Advance CTE and Education Strategy Group worked with states to improve their career readiness systems.

Through NSFY, Delaware, Kentucky, Louisiana, Massachusetts, Nevada, Ohio, Oklahoma, Rhode Island, Tennessee and Wisconsin took action to:

The impact of these states across the entire initiative is highlighted in the NSFY Impact Snapshots and NSFY Impact Summary, which examines the state role in catalyzing and transforming career readiness opportunities for youth.

Through NSFY, 10 states demonstrated the importance of strong state leadership to advance career readiness by setting a clear vision and agenda, catalyzing and scaling pathways and work-based learning, and ensuring access and equity in career readiness opportunities. As a result, the impact of the states was far-reaching. For instance, under NSFY Delaware was able to develop 19 career pathway programs in high-demand occupations and Tennessee was able to ensure that 100 percent of high school students have access to at least four early postsecondary courses.
