Congress Begins August Recess Period | Legislative Update

This week, Congress began its annual August recess while new developments in the presidential elections continue to shape the race. Elsewhere, the U.S. Department of Education (ED) has announced that the application form for postsecondary financial aid has been delayed while the agency solicits new applications for disconnected youth initiatives. 

Lawmakers Head Back Home

After a flurry of activity over the last few weeks, lawmakers in both the House and the Senate began their annual August recess in recent days heading back to home states and districts. Just before leaving Capitol Hill for the month, the Senate Appropriations Committee advanced a 2025 federal fiscal year (FY25) funding measure which would, if enacted, provide a critically needed $35 million increase for the Carl D. Perkins Career and Technical Education Act’s (Perkins V) state grant program. The proposal largely takes a different approach than the House for FY25 and would provide larger funding allocations for ED and the U.S. Department of Labor (DOL) along with the various programs these agencies administer and oversee.

Despite this recent progress, both the House and Senate versions of FY25 funding legislation continue to differ significantly. With FY25 set to begin October 1 of this year, lawmakers will need to determine a pathway for federal funding beyond this date– a topic that is likely to be the priority for Congress when it returns in early September. As these efforts continue to take shape, Advance CTE will be advocating for a strong investment in Perkins V’s State Grant program as well as other critical funding streams in support of Career Technical Education (CTE) opportunities.  

Vice President Harris Taps Minnesota Governor Tim Walz as Running Mate

This week, at a rally in Philadelphia, PA, Vice President Kamala Harris formally introduced Governor Tim Walz (MN) as her running mate, joining her on the top of the Democratic Party ticket for this November’s presidential election. The announcement comes after Harris reportedly narrowed down the field of potential candidates to a group of three. 

Walz, a former teacher from a family of teachers, signed the Free School Meals for Kids bill into law which provides Minnesota public K-12 learners to have access to school-provided breakfast and lunch. During his tenure as Governor, Minnesota also approved a last-dollar financial aid assistance program for students in households making less than $80,000 to cover tuition costs at state institutions. During his time in Congress Walz primarily focused on issues related to agriculture and veterans affairs and co-sponsored a number of pieces of legislation in support of wider education and workforce development efforts. 

U.S. Department of Education Announces Release Schedule For 2025-26 FAFSA Form

After garnering feedback from stakeholders from students, families, and higher education professionals, ED announced this week a new schedule and process for the 2025-26 FAFSA Form launch. This form will be accessible, on a limited basis for testing, on October 1 with a full public release slated to be accessible to all students on or before December 1, 2024. 

Feedback has contributed to the department’s development of a new roadmap that is intended to support users with a more streamlined process and accompanying tools to help them complete the form before the following financial aid school year. More information will be shared in the coming weeks. 

Performance Partnership Pilots for Disconnected Youth Application Announced

This week, ED published a preliminary glimpse at the application process for the selection of Performance Partnership Pilots for disconnected youth (P3). The notice, set to be published early next week, establishes timelines for applications according to the upcoming publish date on the Federal Register. Congress has authorized the pilot since 2014 to allow ED and other agencies to waive certain requirements to access funding streams, like Perkins V and other federal legislation, to better support disconnected youth populations. Recipients of the funds can blend them with other federal resources to better coordinate services for this population of young people, estimated to be around 4.7 million people who are neither working nor in school across the country. Applications for these funding flexibilities will be due within the next two months following the formal publication of this announcement.

WIOA Reauthorization Comes into Focus | Legislative Update

Over the last two weeks, lawmakers have formally considered the reauthorization of the Workforce Innovation and Opportunity Act (WIOA) while Congress continues to move forward on funding proposals with implications for the Career Technical Education (CTE) community for the upcoming fiscal year. 

Senate Considers WIOA Reauthorization

On Wednesday, June 12, the Senate Health, Education, Labor, and Pensions (HELP) Committee held a hearing to examine issues related to the reauthorization of WIOA. The hearing featured testimony from a slate of five witnesses, including experts on youth apprenticeship, workforce development, and employer representatives. Witnesses highlighted the broader goals of the public workforce system, how WIOA is intended to operate, and the need to better resource workforce development efforts to meet these objectives. The issue of reforming the federal Pell Grant program to allow for shorter-term, high-quality CTE programs was a key theme throughout the hearing. Recently lawmakers in the House unsuccessfully tried to advance legislation on this issue in the National Defense Authorization Act. The Senate is widely expected to formally consider separate legislation later this summer. 

In addition, the hearing examined a wide range of issues including the need to more effectively connect programs authorized by WIOA with K-12 education systems as a way to identify youth before they become disconnected from education or work. Senators and witnesses also discussed ways to better incorporate youth apprenticeship programs in high schools and the importance of supportive services and work experience for populations served by WIOA. The Senate HELP Committee is expected to release a discussion draft for WIOA reauthorization in the near future. Advance CTE will provide further analysis and recommendations regarding this proposal when it becomes available.

House Lawmakers Continue to Advance FY25 Funding Proposals

The House has been on a recess period this week while the Senate convened for part of the week around the June 19 federal holiday. Before recessing, the House advanced the National Defense Authorization Act (NDAA)—legislation that sets the policy direction for defense spending for the coming fiscal year. The House narrowly passed the NDAA, largely along party lines due to the inclusion of several contentious amendments by a margin of 217-199. When House lawmakers return next week, they are expected to begin formal consideration of the fiscal year 2025 (FY25) Labor-HHS-ED funding bill—legislation that provides funding for the Carl D. Perkins Career and Technical Education Act (Perkins V) and other key education and workforce development investments. It is widely expected that this legislation will propose significant cuts, as lawmakers did last year, for many programs within this portion of the federal budget. 

More recently, Senate appropriations leaders announced that they will begin the process of considering, marking up, and advancing their own FY25 education funding bill next month. It is widely expected that the Senate will take a much more moderate approach for FY25 funding, although leaders have continued to share concerns regarding the caps currently in place that limit funding available for domestic programs, including for CTE. 

Title IX Rule Blocked

As shared previously, the U.S. Department of Education (ED) recently published new Title IX regulations intended to strengthen protections against sex discrimination. The new rules are scheduled to take effect August 1, 2024 and codify new protections for LGBTQ students, staff, and others against discrimination, including based on one’s sexual orientation or gender identity. Additionally, the regulations will allow school districts to use a more uniform grievance process to address all forms of reported discrimination. However, in recent weeks two separate federal courts have temporarily blocked this rule in several states amid a flurry of lawsuits from Republican-led states objecting to the new rule. Further litigation on this issue is expected and a final resolution remains unclear. 

ED Issues Guidance on Correctional Education

Last month, the U.S. Department of Education’s (ED) Office of Career, Technical, and Adult Education (OCTAE) issued a Dear Colleague letter calling for greater investments in education within correctional settings. The guidance urges states to use a greater share of Perkins V and Adult Education and Family Literacy Act funding for justice-involved populations. The letter argues that greater investment on this issue can help reduce recidivism rates and promote safer communities by helping to facilitate more seamless reentry for these populations.

New Short-Term FY24 Funding Deal Announced | Legislative Update

This week lawmakers returned to Capitol Hill following an extended recess period. With a critical funding deadline landing this week, Congress announced a new short-term extension of existing federal funding to provide more time for ongoing negotiations to continue. Elsewhere, Senate Minority Leader Mitch McConnell has announced that he is stepping down while new apprenticeship grants have been announced by federal agencies. 

Lawmakers Announce New Short-Term Funding Agreement

Two critical funding deadlines for federal fiscal year 2024 (FY24) have swiftly approached: today, March 1, and next week on March 8, when existing FY24 funding is set to expire. As Advance CTE has been sharing for the last several weeks, Congressional leaders have been struggling to find consensus on full-year FY24 appropriations legislation, including the measure that provides funding for the Carl D. Perkins Career and Technical Education Act (Perkins V). 

With time running short, Congressional leaders have been meeting throughout the week to chart a path forward. Late Wednesday evening, Congressional leaders announced a new bipartisan FY24 funding agreement extending these deadlines, at current FY23 funding levels, through March 8 and 22. The new continuing resolution (CR) agreement splits the dozen annual funding measures that compose the federal budget into two tranches. These two tranches now equally divide these measures with half now expiring next Friday, March 8, and the remainder on March 22. Of note for the Career Techincal Education (CTE) community, the House Subcommittee on Labor, Health and Human Services, Education and Related Agencies (Labor-HHS-ED) funding measure, which provides funding for the U.S. Departments of Education (ED) and Labor (DOL) along with programs these agencies administer, lands on the latter of these dates.

This agreement is intended to provide lawmakers with additional time to resolve outstanding issues related to full-year FY24 funding. These issues reportedly continue to center on the inclusion of additional and controversial policies, known as “policy riders,” which some Republican lawmakers are seeking to attach to FY24 funding measures while Democrats have remained opposed. Yesterday, the House passed this additional short-term CR by a 320-99 margin. The Senate quickly took up this latest CR and passed it by a wide, bipartisan basis 77-13. The measure now heads to President Biden’s desk where it will be signed into law prior to the existing March 1 funding deadline. Advance CTE is continuing to advocate for a robust investment in CTE via Perkins V’s basic state grant program as part of this wider process and looks forward to its timely completion soon. 

Senate Minority Leader McConnell Announces Retirement

Senate Minority Leader Mitch McConnell (R-KY) announced earlier this week that he plans to step down from his leadership role later this year and retire at the end of his current Senate term (lasting through 2026). McConnell has led the Senate Republican Conference since 2007. Multiple senators, including John Thune (R-SD), John Cornyn (R-TX), and John Barrasso (R-WY) are widely expected to vie to succeed McConnell later this year. A formal election for the next Senate Republican leader is expected to take place sometime after the upcoming November elections.

DOL Announces $200M in New Apprenticeship Funding  

Earlier this week, the U.S. Department of Labor (DOL) announced the availability of nearly $200 million in new discretionary funding to expand registered apprenticeship programs (RAPs). This latest round of apprenticeship funding includes roughly $100 million in funding for State Apprenticeship Expansion grant funding and $95 million for a second phase of its Apprenticeship Building America, Round 2 (ABA2) grant initiative. Of note for the CTE community, the ABA2 grants include a new priority for applications that emphasize RAP alignment with education systems. 

The funding announcement goes on to indicate that additional priority will be given to applications that include CTE and those that also promote postsecondary credit attainment that can articulate for a degree. These funding opportunities are intended to align with DOL’s wider efforts to update apprenticeship regulations, including broadening training opportunities into more non-traditional economic sectors and for underrepresented populations while emphasizing greater intentional alignment with education systems, including CTE. HELP Committee Renominates Julie Su

Earlier this week the Senate Health, Education, Labor, and Pensions (HELP) Committee reconsidered Julie Su’s nomination to be the next U.S. Secretary of Labor. As a reminder, Su has been serving in an acting capacity as the head of DOL since her nomination stalled in the Senate last year following opposition from Senator Joe Manchin (D-WV) and all Senate Republicans. The committee advanced Su’s nomination on a party line vote, 11-10, but it remains unclear if she will garner the necessary support within the full chamber to be formally confirmed. A time to further consider her nomination has not yet been scheduled.

Legislative Update: Maryland State CTE Director Testifies As Congress Extends FY24 Funding

This week Richard Kincaid, Maryland’s State Career Technical Education (CTE) Director, testified in the House while Congress passed a much-needed extension of federal funding as negotiations continue on federal fiscal year 2024 (FY24) appropriations. 

Lawmakers Pass Last-Minute CR

Lawmakers in the House and the Senate continued to negotiate a path forward on FY24 appropriations this week as two funding deadlines drew closer. As shared last week, Congressional leaders and the White House announced a new deal on aggregate spending levels, known as toplines, for the defense and non-defense discretionary (NDD) portions of the federal budget. This agreement came after months of unsuccessful negotiations between the chambers since the formal start of FY24 on October 1, 2023. 

A new deal on federal topline spending has been a critical next step in moving forward with the dozen funding measures that compose the federal budget since the start of FY24 last fall. While this is an important next step, current federal funding—extended by two separate continuing resolutions (CRs)— was set to expire today and on February 2. Lawmakers therefore had to act quickly this week to avert a partial government shutdown as these negotiations continued. With a snowstorm hitting Washington, D.C. just before the January 19 deadline lawmakers were able to find consensus this week on another set of CRs that extends federal funding through early March. These measures cleared the Senate first on a 77-18 margin and later in the House, under an expedited legislative process, by a margin of 314-108. Notably, nearly half of the House Republican conference voted against this short-term funding extension.  

The Labor-HHS-ED funding measure, which provides funding for education and workforce development investments like the Carl D. Perkins Career and Technical Education Act (Perkins V), is included within a tranche of seven other funding measures that have FY23 funding levels extended through March 8. The remaining four funding bills, which would have expired today, have also been extended through March 1 by this short-term extension. The House is now on recess until January 29 while the Senate remains in session deliberating on federal appropriations and other legislative agenda items.   

As these efforts continue, Advance CTE will continue to advocate for a robust and strengthened investment in Perkins V’s basic state grant program and other investments of interest to the wider CTE community. 

Maryland State CTE Director Testifies Before House Lawmakers

Yesterday, January 18, the House Subcommittee on Early Childhood, Elementary and Secondary Education, led by Reps. Aaron Bean (R-FL) and Suzanne Bonamici (D-OR) held a hearing titled  “Preparing Students for Success in the Skills-Based Economy.” Notably, Richard Kincaid, Senior Executive Director for the Maryland State Department of Education’s Office of College and Career Pathways and a member of Advance CTE, testified at the hearing along with several other witnesses including Kelly Mosley, a local CTE Director in Clay County Florida, along with Danny Corwin, Executive Director of Harbor Freight Tools for Schools.

Richard’s testimony focused on Maryland’s ongoing efforts to provide pathways to opportunity for all students. Specifically, his remarks highlighted the state’s work to implement the Blueprint for Maryland’s Future, a multi-billion dollar statewide investment that aims to provide “…all students [with] equitable access to rigorous education that prepares them for college, career and life…” among other aspects of the effort. Richard also highlighted the state’s use of American Rescue Plan funding via the Elementary and Secondary School Relief (ESSER) program which has supported a substantial expansion of youth apprenticeship programs in the state. 

More broadly the hearing touched on a number of topics related to secondary CTE, including and especially the need to invest additional resources into these efforts to provide more opportunities for learners. For instance, during her line of questioning, Rep. Bonamici, also the co-chair of the House CTE Caucus and Ranking Member of this subcommittee, highlighted that the federal investment in CTE, made by Perkins, has eroded considerably over the last few decades and asked what additional funding could do for states like Maryland. Kincaid answered, in part,  that “…using Perkins as a lever to reinvest additional funding into these programs would be a game changer for places like Maryland that rely on federal funds to move this agenda forward…” 

Elsewhere, recent research conducted by Advance CTE on secondary CTE financing was also highlighted by witnesses, including Harbor Freight’s Corwin who shared a startling datapoint with lawmakers– funding for CTE represents just three percent of all K-12 spending in the United States. More importantly, without the federal investment made by Perkins V’s basic state grant program, this percentage drops to just one percent of all K-12 spending across the nation, underscoring the enormous importance of strengthening and drastically increasing federal funding for CTE. 

Advance CTE applauds lawmakers in the House for holding this hearing and providing these witnesses an opportunity to highlight how important it is to increase opportunities for learners to engage with high-quality CTE opportunities in their communities. Legislative Update: Congress Extends Funding Through Early Next Year

This week, Congress passed another short-term extension of current funding for all federal programs and operations through early 2024. The measure maintains current funding levels for the Carl D. Perkins Career and Technical Education Act (Perkins V) along with other critical investments in education and workforce development. 

Congress Approves Funding Extension

After weeks of uncertainty, newly elected Speaker Mike Johnson (R-LA) announced plans over the weekend to advance legislation that would temporarily extend current federal fiscal year 2023 (FY23) funds through early next year. The legislation bifurcates the 12 individual spending bills that compose the federal government into two separate tranches — known as a “laddered” continuing resolution (CR) — with two separate expiration dates of January 19 and February 2. Of note for the Career Technical Education (CTE) community, the Labor, Health and Human Services, Education and Related Agencies (Labor-HHS-ED) appropriations component of this legislation would extend funding for programs like Perkins V and the Workforce Innovation and Opportunity Act (WIOA) through the February 2 deadline.

The laddered CR approach was initially met with skepticism by some lawmakers, as the strategy does not appear to fundamentally change the underlying dynamics of Congress’ current challenges in finding common ground on full-year FY24 spending. Nonetheless, the measure was introduced in the House this week and passed by an overwhelming bipartisan majority by a margin of 336-95. Notably, 93 Republicans and two Democrats voted against the measure—a dynamic that, just a few months ago, led to the surprising ouster of former Speaker Kevin McCarthy earlier this fall. The laddered CR was quickly taken up by the Senate where it was passed on a bipartisan basis by a margin of 87-11. The bill was just recently signed into law by President Biden before current funding legislation was set to expire later today (November 17).

Ostensibly, the passage of a CR is intended to provide lawmakers more time to negotiate FY24 appropriations legislation. However, both chambers have struggled to make progress on their respective slates of appropriations legislation. Meanwhile, in the House, Republican leaders were forced to pull the Labor-HHS-ED appropriations bill from further consideration after it became clear the measure would likely not have the necessary support to clear the chamber. House leaders were forced to pull other spending measures from consideration for similar reasons the last few weeks as well.

While the passage of the CR will avoid a government shutdown for the remainder of this calendar year, it remains unclear how Congress will use this additional time to either pass additional individual appropriations legislation, negotiate a larger full-year FY24 package or take an alternative route altogether. Advance CTE is continuing to engage with partners on Capitol Hill to ensure that the funding needs of the CTE community are realized as part of this wider process.

Legislative Update: Senate Returns from August Recess to Busy Fall Agenda

The Senate returned to Capitol Hill this past Tuesday following its annual August recess while lawmakers in the House are expected to return next week. Elsewhere, policymakers have started to collect ideas regarding how Artificial Intelligence (AI) will impact education and workforce development, while the U.S. Secretary of Education launches a back-to-school bus tour, announces educator diversity efforts and issues new guidance related to teaching and learning in schools. 

Senate Reconvenes for New Work Period

The Senate reconvened this week following its annual August recess. Lawmakers in the House are due back to Capitol Hill next week. On their return to Washington, D.C., the Senate has focused primarily on addressing Congress’s failure to complete work on the fiscal year 2024 (FY24) budget before the new fiscal year begins on October 1. Just before August recess, the Senate appropriations committee successfully advanced all 12 of the individual appropriations bills that compose the federal budget on a bipartisan basis but these proposals have yet to be approved by the full chamber and reconciled with forthcoming proposals in the House. 

Lawmakers in the House, meanwhile, have been unable to similarly advance their own spending proposals, including legislation providing funding for Career Technical Education (CTE) via the Carl D. Perkins Career and Technical Education Act (Perkins V*). More importantly, the House and Senate’s proposed funding levels for FY24 differ substantially, with lawmakers in the lower chamber proposing significant cuts to federal spending which do not conform to the Fiscal Responsibility Act (FRA)—a legislative agreement reached earlier this year that prevented a default on the nation’s debt obligations.

Stopgap legislation, known as a continuing resolution (CR), will likely be needed to avert a government shutdown when the new fiscal year begins later this month. Federal lawmakers are continuing to negotiate a path forward. Conservative lawmakers in the House recently issued a series of policy and spending demands in exchange for their support for any CR, including prioritizing spending levels that fall well below those required by the FRA. House Republicans, led by Speaker McCarthy (R-CA), have further indicated that they want a shorter-term CR rather than one lasting through the end of the year while the Senate and the Biden Administration want a temporary funding extension lasting until the holiday season to provide more time to negotiate a full-year appropriations package.

Given the significant differences between the House and Senate FY24 spending proposals and the positions currently taken by the House, Senate, and the White House, negotiations are expected to be extremely contentious in the coming weeks and months ahead. As these talks move forward, Advance CTE will continue to advocate for robust funding for critical funding streams important to the CTE community. Ranking Member Cassidy Issues Request for Information on AI

On September 6, Senate Health, Education, Labor, and Pensions (HELP) Committee Ranking Member Cassidy (R-LA) published a new white paper on artificial intelligence and the potential implications for policy areas falling under the HELP Committee’s jurisdiction. AI is still an emerging topic for Congress with two hearings scheduled next week in the Senate within the Judiciary and Commerce Committees.

Ranking Member Cassidy has requested feedback from the public and stakeholders regarding several issues likely to arise in the coming years as AI is further deployed and leveraged in different facets of daily life, including in education and workforce development. Specifically, the Ranking Member seeks feedback on whether and how AI can be used in educational settings, how education leaders promote a better understanding of AI, both among students and their peers, and how these technologies can be used to improve student learning while not diminishing learners’ critical thinking skills. Notably, the white paper includes several questions related to whether and how CTE systems and programs can leverage AI and provide learners more opportunities to pursue pathways in related fields. 

ED Launches Back to School Bus Tour

U.S. Secretary of Education Miguel Cardona has been on a “Back to School Bus Tour 2023: Raise the Bar”—a week-long multi-state trip across the nation to highlight the work schools, districts, institutions, and states are doing to support students as they collectively return to classrooms over the next few weeks. The tour includes stops in Kansas, Missouri, Illinois, Wisconsin and Minnesota and features priorities and initiatives that the agency has been promoting throughout the Biden Administration, including its “Career Connected High School” efforts which are intended to promote key pillars of high-quality CTE. In addition, the Department also recently published a factsheet highlighting the Biden Administration’s ongoing efforts to support learners as they return to school this fall. 

ED Announces Educator Diversity Efforts

The U.S. Department of Education (ED) has announced that it will host two convenings in late October to find, promote and encourage wider educator diversity efforts. The first of these national meetings will be a Conference on Equity in Opportunity and will be held in Denver October 26-27. The second meeting, the Teach to Lead Summit, will take place in Denver on October 27. The announcement also highlighted recent ED efforts to prioritize teacher diversity including through investments in teacher quality partnership grants, August Hawkins Centers of Excellence programs, and the Supporting Effective Educator Development. Office of Civil Rights Issues New Guidance on Race and School Programming

Late last month, ED’s Office of Civil Rights (OCR) issued new guidance regarding how and in what ways schools may include programming aimed at fostering racially inclusive communities. The guidance updates OCR’s legal interpretation of Title VI of the Civil Rights Act of 1964 which provides further clarity regarding under what circumstances schools may develop curricula and provide programs that promote racially inclusive school communities. “Today’s resource shares with school communities practical guidance about whether and when federal civil rights laws permit – and in some cases require – schools to take actions related to race, as well as whether and when these same laws may require that schools not act based on race,” said Assistant Secretary for Civil Rights Catherine E. Lhamon during the release of this guidance. The full letter can be accessed here

Legislative Update: House Examines Skills-Based Hiring as Senate Sets Spending Toplines

This week, the Senate has continued to make progress on federal appropriations legislation while lawmakers in the House explored skills-based hiring efforts underway across the country. Meanwhile, federal agencies have announced the availability of new grants aimed at supporting tribal education. 

Senate Appropriators Set Funding Framework

As previously shared, the legislative agreement Congress and President Biden reached in recent weeks, known as the Fiscal Responsibility Act (FRA), extends the nation’s borrowing authority for the next two years. Of significance for the Career Technical Education (CTE) community, the FRA establishes new spending caps for that same period of time for federal fiscal years 2024 (FY24) and FY25. In a recent development last week, House Republicans announced their intention to move forward with individual spending bills that, taken together, provide much less funding for domestic programs, like the Carl D. Perkins Career and Technical Education Act (Perkins V)*  than required by the FRA. This sets up a likely scenario where the House and Senate propose radically different funding levels for the upcoming federal fiscal year, set to formally begin on October 1, 2023.  

Meanwhile, the Senate Appropriations Committee, led by Chair Patty Murray (D-WA) and Ranking Member Susan Collins (R-ME), recently met to establish topline spending caps, known as 302(b)s, that align with the FRA. The committee considered these proposed 302(b) allocations yesterday and advanced them along party lines as Republicans on the panel remained concerned regarding funding levels for defense programs. Broadly the Senate’s 302(b) allocations are intended to provide roughly the same amount of funding for education and workforce development programs, like Perkins V, at current federal fiscal year 2023 (FY23) levels. In practical terms, however, the differences between the House and the Senate’s proposed visions for FY24 funding may prove challenging to reconcile as the October 1 deadline for FY24 draws nearer.

As these efforts continue to take shape, Advance CTE will be closely engaging with lawmakers on Capitol Hill to ensure that the significant funding needs of the CTE community are realized as part of the ongoing budget and appropriations process for FY24.

House Explores Skills-based Hiring

On Thursday, June 22, the House Education and Workforce Committee held a hearing titled “Competencies Over Degrees: Transitioning to a Skills-based Economy.” The hearing focused on changes that could be made to reorient systems of education, workforce development, and employment to strengthen approaches and programs that provide skills needed for further economic opportunities and to better reward the attainment of these competencies in the labor market. The hearing also highlighted the issue of the “paper ceiling”–the issue of increasing numbers of workers being overlooked for jobs they would otherwise qualify for because they lack a four-year degree. 

Witnesses and lawmakers explored a wide array of issues in this context, including potential changes to the Workforce Innovation and Opportunity Act (WIOA) and federal apprenticeship legislation to facilitate this vision for the future. In addition, House CTE Caucus Co-chair Glenn “GT” Thompson (R-PA) highlighted the need for further investment in CTE and noted that many programs in his district have waiting lists for learners– indicating that demand for CTE pathways is continuing to exceed current supply. ED Announces New Native Language Grants

Last week, The U.S. Department of Education (ED) announced the availability of approximately $8 million in new funding intended to support several federal initiatives aimed at better supporting Indigenous learners. “Our efforts to Raise the Bar for multilingual learners includes strengthening and revitalizing Native languages and the recruitment, retention, and leadership of Native educators,” U.S. Secretary of Education Miguel Cardona said as part of the announcement. The new grantmaking is aimed at three separate ED initiatives that together are aimed at increasing the capacity of Indigenous communities to serve learners, preserve Native languages, and promote educator recruitment and retention efforts through the nation. Legislative Update: FY24 Funding Continues to Take Shape

This week, congressional leaders continued to look ahead to next steps for the 2024 federal budget and appropriations process ahead of important deadlines this fall and early next year. Elsewhere, lawmakers in the House examined innovative approaches to postsecondary education.

House Republicans Propose Significant Cuts to Domestic Spending

After months of on-and-off again negotiations, congressional leaders and President Biden recently reached a deal to suspend the debt ceiling and avert a catastrophic default on the nation’s debt obligations. The agreement, known as the Fiscal Responsibility Act (FRA), extends the nation’s borrowing authority for the next two years and, importantly for the Career and Technical Education (CTE) community, establishes new spending caps for that same period of time for federal fiscal years 2024 (FY24) and 2025 (FY25). The FRA was signed into law by President Biden on June 3, following intense negotiations between Democrats and Republicans. Upon the release of the agreement, House Republican leadership touted the FRA saying, in part, “The Fiscal Responsibility Act does what is responsible for our children, what is possible in divided government, and what is required by our principles and promises.”

More recently, however, House Republicans have signaled that they intend to move forward with FY24 spending bills that do not conform to the spending cap requirements contained in the FRA. In a recent development earlier this week, the top House Republican appropriator, Rep. Kay Granger (R-TX), announced that she plans to move forward with a series of spending bills that reduce federal spending to FY22 levels, rather than FY23 as required by the FRA. Recent press reports have indicated that the committee is planning to advance spending legislation for the Labor, Health and Human Services, Education spending bill, where the Carl D. Perkins Career and Technical Education (Perkins V) and other education programs derive funding from. The bill could potentially include an up to $60 billion cut to funding for this portion of the federal budget—a nearly one-third reduction in funding over current levels of investment.

In the Senate, Appropriations Committee Chair Patty Murray (D-WA) and Ranking Member Susan Collins (R-ME) have indicated that they plan to move forward with FY24 spending proposals in the coming weeks that do conform to the FRA. This puts Congress on a likely path towards another future disagreement over federal spending later this fall, with the chambers potentially moving forward with spending proposals that are dramatically different. This will have the practical effect of making reconciling the differences between the chambers’ proposals even more challenging ahead of the start of FY24, set to begin on October 1. As a reminder, a mandatory, across-the-board sequester cut of one percent to all federal spending would be applied should Congress not reach agreement on full-year FY24 funding  by January 1 of next year. As these efforts continue, Advance CTE will be closely monitoring these developments and engaging with partners on Capitol Hill to ensure the funding needs of the CTE community are realized as part of this ongoing budget and appropriations process for FY24. 

House Examines Postsecondary Innovation

On Wednesday, June 14, the House Education and Workforce Committee held a hearing titled “Postsecondary Innovation: Preparing Students for Tomorrow’s Opportunities.” The hearing focused on the need to fundamentally rethink many aspects of postsecondary education, with witnesses and lawmakers discussing at length the important role career development and planning has both before, during, and after postsecondary experiences to ensure learner success. In addition, the importance of dual and concurrent enrollment opportunities was highlighted extensively during the hearing as was the need to fully invest earlier on in the educational continuum—a key strategy emphasized during the hearing to prepare students earlier on for their future endeavors. Legislative Update: Teacher Pay and Healthcare Workforce Shortages a Focus as Senate Agenda Begins to Unfold

Over the last two weeks, lawmakers have largely been on a recess period while the Senate has continued to take steps to organize within the chamber. Elsewhere, leaders in the Senate have drawn attention to the issue of teacher pay while also examining workforce shortages within the healthcare industry. 

HELP Committee Holds Healthcare Shortage Hearing

The Senate Health, Education, Labor and Pensions Committee (HELP) held a hearing on February 16 to examine persistent workforce shortages within the healthcare industry. Witnesses included an array of postsecondary institutional leaders, many of whom emphasized the importance of quality career advisement starting in high school and middle school. The hearing also emphasized the importance of early career exposure, to help put more students on pathways leading to careers in the healthcare industry. Witnesses highlighted the impact of high-quality work-based learning opportunities, particularly apprenticeships, as a useful strategy to meet ongoing workforce challenges in the sector. Senate HELP Committee Chair Sanders Hosts Teacher Pay Town Hall

Last week, Senator Sanders (I-VT) held a town hall with leaders of the two largest teacher unions, as well as Senator Markey (D-MA) along with several teachers, to raise awareness about the issue of teacher pay and to tout forthcoming legislation that would create a nationwide minimum salary for K-12 teachers. “Raising teacher salaries to at least $60,000 a year and ensuring competitive pay for all of our teachers is one of the most important steps we can take to address the teacher shortage in America and to improve the quality of our public school system in America,” Sanders said during the event. Senate Appropriations Committee Takes Shape

Last week, the new Chair joined by the Ranking Member of the Senate Appropriations committee—Senators Patty Murray (D-WA) and Susan Collins (R-ME) respectively— announced the leaders for the individual subcommittees that compose the appropriations committee and oversee federal funding for the 12 spending accounts that make up the federal budget. Of note for the CTE community, Senators Tammy Baldwin (D-WI), co-chair of the Senate CTE Caucus, along with Shelly Moore Capito (R-WV), will serve as Chair and Ranking Member, respectively, of the Labor, Health and Human Services, Education and Related Agencies Subcommittee—the entity that oversees and determines annual investments in the Carl D. Perkins Career and Technical Education Act (Perkins V) and other federal education and workforce programs of interest to the CTE community. More information on the announcement can be found here.

Secretary of Labor Walsh Resigning 

After serving as U.S. Secretary of Labor for the last two years, Marty Walsh has announced that he will be resigning from this position in mid-March. In a goodbye letter to his Department, Walsh acknowledged U.S. Department of Labor Deputy Secretary Julie Su saying, in part, “. . .Julie is an incredible leader and has been central to our success as a team and as a department. With the kind of leadership and talent assembled across the department, I am confident there will be continuity and the work will be sustained.” Walsh is leaving the department to lead the National Hockey League’s Players’ Association as the group’s next Executive Director. 

Encourage Congress to Support the Short-term Pell Grant Expansion

As shared previously, Senators Tim Kaine (D-VA) and Mike Braun (R-IN) reintroduced the Jumpstarting our Businesses by Supporting Students (JOBS) Act (S.161)– legislation that would expand federal Pell grant funding eligibility to high-quality, shorter-term CTE programs that meet certain criteria. Most recently companion legislation has been introduced in the House (H.R. 793) by Representatives Bill Johnson (R-OH), Lisa Blunt-Rochester (D-DE), Michael Turner (R-OH) and Mikie Sherrill (D-NJ). 

This legislation is a key and longstanding federal policy priority for Advance CTE as it is an important way to expand learner access to high-quality CTE program opportunities at the postsecondary level.
